S (Series of 1989) AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF FIVE (5) PRE- CINCTS FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON MAY 2, 1989, AND SETTING FORTH THE DESCRIPTION OF THOSE PRECINCTS WHEREAS, the City council ("council") of the City of Aspen, Colorado (the "City"), in the County of pitkin and State of Colorado, a municipal corporation duly organized and existing as a home rule city pursuant to Article XX of the Colorado Constitu- tion, will conduct a general municipal election, pursuant to section 2.2 of the Aspen Home Rule Charter, on Tuesday, May 2, 1989; and WHEREAS, Council has determined, and hereby does determine that the use of the five (5) general election precincts for said general municipal election will maximize the convenience of the voters; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1 Pursuant to section 2.3 of the Aspen Home Rule Charter, the Council has heretofore adopted Ordinance No. 5-71, establishing multiple voting precincts. The Council has determined, and hereby does determine, that, solely for purposes of the general municipal election to be held May 2, 1989, the City shall con- stitute five (5) voting precincts, the boundaries of which shall be the same as the boundaries of the general election precincts (General Election Precinct Nos. 1, 2, 3, 4 and 5 and those areas recently annexed) previously established for use in connection with general election, which five (5) precincts are described in Exhibit "A" attached hereto and incorporated herein by this reference. This ordinance shall supercede said Ordinance No. 5- 71, but only as to the August 9, 1989, general municipal elec- tion. section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
