AN ORDINANCE DESIGNATING 430 WEST MAIN STREET, 406 WEST SMUGGLER
STREET AND 210 SOUTH GALENA STREET, AS H, HISTORIC LANDMARK
PURSUANT TO DIVISION 7, SECTION 7-701 OF THE LAND USE CODE.
WHEREAS, Glenn A. Beck, as owner of the real property
described as 430 West Main street, Lots K, L, and M, Block 37,
city and Townsite of Aspen; Christie Ann Kienast, as owner of the
real property described as 406 West Smuggler Street, Lots P & Q,
Block 33, City and Townsite of Aspen and Lots 16 and 17, Block
33, Hallam's Addition to the City and Townsite of Aspen; and The
Elks Club #224, as owner of the real property described at 210
South Galena Street, Lots K, L, and M, Block 94, City and
Townsite of Aspen, have filed an application for historic
landmark designation pursuant to section 7-701 of the Land Use
Code, and
WHEREAS, the property at 430 West Main Street was listed in
the 1980 Inventory of Historic sites and Structures, as amended
in 1986, and has received the historic evaluation rating of "3";
the property at 406 West Smuggler Street was listed in the 1980
Inventory of Historic sites and Structures, as amended in 1986,
and has received the historic evaluation rating of "3"; and the
property at 210 South Galena Street was listed in the 1980
Inventory of Historic sites and Structures, as amended in 1986,
and has received the historic evaluation rating of "Exceptional";
and,
WHEREAS, the Historic Preservation Committee recommended
historic designation for 430 West Main street and 406 West

Smuggler street at a duly noticed public hearing on May 24, 1989,
and recommended historic designation for 210 South Galena Street
at a duly noticed public hearing on June 14, 1989; and,
WHEREAS, the Aspen Planning and Zoning commission
recommended historic designation for all three structures at a
duly noticed public hearing on July 5, 1989; and
WHEREAS, City Council wishes to pursue those recommendations
and complete the designation process.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the property at 430 West Main Street, described as Lots K,
L, and M, Block 37, City and Townsite of Aspen; and the property
at 406 West Smuggler Street, described as Lots P and Q, Block 33,
City and Townsite of Aspen and Lots 16 and 17, Block 33, Hallam's
Addition to the City and Townsite of Aspen; and the property at
210 South Galena Street, described as Lots K, L, and M, Block 94,
city and Townsite of Aspen, be granted H, Historic Landmark
Designation.
Section 2
That the Zoning District Map be amended to reflect the rezoning
described in Section 1 and the Planning Director shall be
authorized and directed to amend said map to reflect said

rezoning.
section 3
That the Planning Director shall be directed to notify the City
Clerk of such designation, who shall record among real estate
records of the Pitkin County Clerk and Recorder's Office a
certified copy of this ordinance.
section 4
That if any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.

prior to which hearing notice of the same shall be published once
