AN ORDINANCE APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT
BETWEEN THE CITY OF ASPEN AND THE MAROON CREEK DEVELOPMENT CORP
SETTING FORTH THE TERMS AND CONDITIONS FOR THE LONG-TERM LEASING
OF THE PROPERTY COMMONLY KNOWN AS THE ZOLINE PROPERTY FOR THE
CONSTRUCTION AND OPERATION OF A GOLF COURSE
WHEREAS, on August 9, 1988, the voters of the City of Aspen
authorized the City of Aspen to lease (long term) all or a
portion of the real property acquired for open space purposes
from the Zoline Foundation; and
WHEREAS, there has been presented to the City Council a
lease agreement between the City of Aspen and the Maroon Creek
Development Corp., a Colorado corporation, which agreement is
appended hereto and incorporated herein by reference; and
WHEREAS, the City Council desires to approve said lease
agreement and direct the Mayor to execute the lease on behalf of
the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The City Council does hereby approve that certain lease
agreement between the city of Aspen and Maroon Creek Development
Corp. concerning the open space lands acquired from the Zoline
Foundation, which lease agreement is attached hereto and incor-
porated herein by this reference, and does hereby further direct
the Mayor to execute such agreement on behalf of the City of
Aspen.
section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
