HomeMy WebLinkAboutordinance.council.029-90 -- ,:- ~(- ORDINANCE NO. 29 (SERIES OF 1990) AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING SUBDIVISION EXEMPTION FOR THE CONDOMINIUMIZATION FOR THE COOPER AVENUE GREYS TONE CONDOMINIUMS, 810-816 COOPER AVENUE WHEREAS, pursuant to section 7-1007 of the Aspen Land Use Code, a Condominiumization is a subdivision exemption by the Clty Councll; and WHEREAS, Harlan Dopkln has submltted an application for the condomlnlumlzatlon of the three new resldential units belng constructed at 810-816 cooper Avenue (which includes the deed restricted studio unit); and WHEREAS, the Engineering Department, having reviewed the application has made referral comments; and WHEREAS, the Planning Office, the having revlewed application pursuant to Section 7-1007, and the referral comments from Engineering recommends approval wlth the following condltions: 1. Prlor to the issuance of a building permit, the applicant shall file deed restriction agreements between the applicant and the Clty of Aspen (to be approved by the City Attorney) requiring a six month minimum lease, with not more than two shorter tenancles per year. This agreement will be duly recorded In the real estate records of Pitkin County to ensure compllance wlth the lease restrlction and eVldences the applicant I s compllance with the minimum lease requirements of the Code; and 2 . Prlor to the lssuance of a Certiflcate of occupancy the ^'""'" e "e I'>' " ,A '. project shall be subject to a final inspectlon. 3. Prior to the plat belng slgned, the appllcant must submlt storm runoff facllitles and deslgn and calculations prepared by a reglstered engineer to be reviewed by the Englneerlng Department. 4. Prior to the issuance of a bUllding permlt, the dumpster shall be relocated onto the private property as shown on the plat and as was required wlth prevlous approvals. 5. The applicant shall grant, and lndicate on the plat, a six foot by elght foot transformer easement at the northeast corner of the parcel. 6. Prior to flling the final plat, an lnspection of the new drlveway shall be conducted by the Engineering Department. 7. The applicant shall agree to join any future improvement dls- tricts which may be formed; and WHEREAS, the Aspen City Council having consldered the Planning Department's recommendation for condominiumlzatlon does wish to grant the requested subdivislon exemptlon for the Cooper Avenue Greystone Condominlums, 810-816 Cooper Avenue. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1: That lS does hereby grant a subdivlsion exemption for condominlumlzation, with the prevlously mentioned conditions recommended by the Aspen Planning Department, to the Greystone Condominiums, 810-816 Cooper Avenue, Lots N & 0, Block 111. 2 ~ \e 1,- - ,I I section 2: That the City Clerk be and hereby is dlrected, upon the adoption of thls ordlnance, to record a copy of this ordinance in the office of the Pitkin County Clerk and Recorder. section 3: If any sectlon, subsectlon, sentence, clause, phrase or portlon of this ordinance is for any reason held invalld or unconstltutlonal by any court of competent jurisdlctlon, such provision and such holding shall not affect the validity of the remaining portions thereof. section 4: Nothing In this ordlnance shall be construed to affect any right, duty or 1iablllty under any ordinance in effect prior to the effectlve date of this ordinance, and the same shall be continued and concluded under such prior ordinances. section 5: A public hearlng on the Ordinance shall be held on the 14 day of May, 1990 at 5:00 P.M. in the Clty Council chambers, Aspen ci ty Hall, Aspen Colorado, flfteen (15) days prior to which hearing a public notice of the same shall be publlshed one in a newspaper of general circulation within the City of Aspen.
