ORDINANCE NO. B-S-
(SERIES OF 1990)
AN ORDINANCE OF THE CITY OF ASPEN VESTING THE DEVELOPMENT RIGHTS
FOR THE VOLK STREAM MARGIN REVIEW
WHEREAS,
a request for Vested Rights for the Volk
Stream Margin Review was submitted to the Planning Office by
proJect representatlve Sunny Vanni and
WHEREAS, pursuant to section 6-207 of the Aspen Land Use
Code, the city Council may grant Vestlng of Development Rights
for a period of three years; and
WHEREAS, the Plannlng Office recommends that Council approve
Vesting of Development Rlghts for the Volk Stream Margin Review;
and
WHEREAS, the Aspen City Council having consldered the
Plannlng Office's recommendations for Vestlng Development Rights
does wlsh to grant the requested Vesting of Development Rights
for the Volk Stream Margin Review for three years from the date
of approval .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1:
That it does hereby grant Vested Rlghts for the Volk Stream
Margin ReVlew for a period of three (3) years from the date of
approval in accordance to the terms and provisions of Sectlon 6-
207 of the Aspen Land Use Code.
Section 2:
That the city Clerk be and hereby lS directed, upon the

section 3:
If any section, subsection, sentence, clause, phrase or
portion of thlS ordinance is for any reason invalld or
unconstltutlonal by any court of competent jurisdlctlon, such
provision and such holding shall not affect the valldity of the
remaining portions thereof.
section 4:
Nothlng in this ordlnance shall be construed to affect any
rlght, duty or liabllity under any ordinance in effect prior to
the effective date of thlS ordi.nance, and the same shall be
continued and concluded under such prlor ordinances.
section 5:
the Ordinance shall be held on the /~

Aspen iCty Hall, Aspen Colorado, fifteen (15) days prlor to which
a hearing of public notice of the same shall be published in a
newspaper of general circulation within the City of Aspen.
