ORDINANCE 37
(Series of 1990)
AN ORDINANCE AMENDING ORDINANCE 9, SERIES OF 1990, WHICH PROVIDED
FOR THE RELEASE OF RESTRICTIONS AS THEY RELATE TO UNIT
CORKSCREW CONDOMINIUMS, IN ORDER TO CORRECT AN ERROR THEREIN.
WHEREAS, Ordinance 9, Series of 1990, erroneously required
in Section 2 thereof the payment of a cash-in-lieu fee by the
current owner of Unit ~2~ Corkscrew Condomlnlums~ in order to
secure the release of certain Housmng Authority deed restrictions
imposed upon such un~t; and
WHEREAS, the owner and the C~ty Council desire to correct
the error and to restate herein the owner's oblmgatlons in order
to secure the release of the aforementioned deed restrictions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
Section 1 of Ordinance 9, Series of 1990~ ~s hereby amended
to read as follows:
Section 1
The owner of Aspen West Condominium, Unit ~5, 104
West Cooper Avenue, Aspen, Colorado, shall execute and
record an approved rental sale deed restriction as
required by the Aspen/P~tkin County Housing Authority
restricting sa~d Unit ~5 to low-income rental/sale
guidelInes with respect to oecupancy~ income and price
standards as contained in the Aspen/Pmtkin County
Housing Authority guidelines, as amended from time to
time. Said Unit ~5 shall be l~sted for sale to
qualified buyers wmth the Aspen/Pltk~n County Housing
Authority within 30 days of the effective date of this
ordinance.
Sect!on 2
Section 2 of Ordinance 9, Series of 1990, is hereby amended
to read as follows:
Section 2
Upon the recordation of the restrlctlons llsted
Paragraph 1 above, City shall cause Unit ~2 of the
Corkscrew Condominiums to be released from the
Declaration of Covenants, Restrictions and Conditions
for Corkscrew Condominium Duplex, as recorded
Book 426 at Page 971 of the real property records of
the Pltkln County Clerk and Recorder's office for
P~tkin County.
