CITY OF ASPEN, COLORADO ORDINANCE NO. 90-52 SERIES OF 1990 AN ORDINANCE ENTITLED: EXTENSION OF MUNICIPAL WATER TRANSMISSION LINES TO THE ASPEN/PITKIN COUNTY HOUSING AUTHORITY PROPERTY WHEREAS, the Aspen/Pitkin County Housing Author1ty ("Housing Authority") has requested the extension of municipal water service to their property located outs1de the present munic1pal boundaries, and WHEREAS, the Hous1ng Authority plans to develop a qualif1ed employee housing project on the property in accordance w1th ~ 23-71 of the Mun1c1pal Code of the City of Aspen, Colorado, such project to be named the Twin Ridge Employee Housing Project, and WHEREAS, the Home Rule Charter for the City of Aspen, Colorado, Art. XI, section 11.3 provides that extensions of the mun1cipal water transm1ssion lines beyond C1ty boundaries may be authorized by the city Council, such authorization to be by Ordinance, and WHEREAS, the City and the Housing Authority have negot1ated a Water Serv1ce Agreement, to provide for the extension of water service and the payment for the necessary facil1ties to accomplish 1 :e ita ,. ., the extens1on, 1n the form of a f1nal Agreement, executed by the Aspen/Pitkin County Housing Authority, presented to the Council on June 25, 1990, and WHEREAS, no water service may be provided until approved by the Board of County Commissioners of Pitkin County in accordance with Resolution 13-73 of P1tkin County. NOW THEREFORE, be it ordained by the City Council of the C1ty of Aspen, Colorado, SECTION 1 The City Counc11 hereby finds that the extension of water service to the Housing Authority property is in the best interests of the city and promotes the public health and safety of water users connected to the Aspen Municipal Water System. The Mayor and the City Clerk are hereby directed to execute on behalf of the C1ty a Water Service Agreement with the Housing Authority, said Agreement be1ng attached hereto as Exh1bit 1. SECTION 2 The Water Service Agreement is not effective until approved in accordance with Resolution 13-73 of Pitkin County. 2 (e :e e ,/ , SECTION 3 If any prov1sion of this Ordinance 1S for any reason held 1nvalid or unconst1tutional by any court of competent Jurisdiction, such prov1s1on shall be deemed a separate, distinct, and 1ndependent prov1sion, and such holding shall not affect the validity of the rema1ning portions hereof.
