HomeMy WebLinkAboutordinance.council.056-90 ORDINANCE NO. 56 (Series of 1990) A~ ORDINA/~CE A~ENDING ORDINANCE NO. 28 (SERIES OF 1988) TO REFINE THE CITY ORGANIZATION INTO FOUR CITY AGENCIES AND TWO DEPART- MENTS, TO BE KNOWN AS "ASSISTANT CITY MANAGER AGENCY", "ADMINIS- TRATIVE SERVICES AGENCY", "PUBLIC SAFETY AGENCY", "PUBLIC WORKS AGENCY", "PLANNING & ZONING DEPARTMENT" AND "ENVIRONMENTAL HEALTH DEPARTMENT". WHEREAS, pursuant to Ordinance No. 28 (Series of 1988) the city Council approved the organization of existing City depart- ments into four agencies and one department; and WHEREAS, upon the recommendation of the City Manager, the City Council desires to amend Ordinance No. 28 (Series of 1988) and approve and authorize the City Manager to create an A~istant City Manager and Administrative Services Agencies; (1) delete the Deputy City Manager position, and create an Assistant City Manager position which is directly responsible for managing the departments of Golf, Ice Garden, Parks, Recreation, Wheeler Opera House, Parking and Personnel; and (2) create an Administrative Services Director position which is directly responsible for managing the functions and departments of Finance, Data Processing and Municipal Court; and (3) reassign Environmental Health to the City Manager in order to comply with the intergovernmental agreement with Pltkin County regarding a joint Environmental Health Department, and reassign City Clerk to City Manger; and (4) maintain the existing management responsibilities of the Public Safety Director for pollce; and (5) maintain the existing Public Works Agency to be respon- sible for management functions and departments for the Electric, Engineering, Streets and Water; and (6) maintain joint Planning and Zoning Department as a City Agency per the intergovernmental agreement with Pitkln County. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1 That Ordinance No. 56 (Series of 1990) be adopted to provide that the city departments be organized into four agencies and two departments, as follows: Assistant City Manager Agency, Adminis- trative Services Agency, Public Safety Agency, Public Works Agency, and Planning and Zoning Department and the Environmental ""'0 Health Department. Section 2 This ordinance shall not have any effect on existing litiga- tion and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be construed and concluded under such prior ordinances. Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdictIon, such portion shall be deemed a separate~ distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 4 A public hearing on the ordinance shall be held on the ~ day of ~ , 1990, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
