(Series of 1991) AN ORDINANCE DESIGNATING 716 W. FRANCIS ST., 620 W. HALLAM ST., AND 214 W. BLEEKER ST., AS H, HISTORIC LANDMARK PURSUANT TO DIVISION 7, SECTION 7-701 OF THE LAND USE CODE. WHEREAS, Joseph Bellina and Delia Bellina, as owners of the structures and real property described as 716 W. Francis st., Lots Nand 0 and the West 15 feet of Lot P, Block 15, city and Townsite of Aspen; and WHEREAS, David Zimman and Marie Zimman, as owners of the structures and real property described as 620 W. Hallam st., the East 1/2 of Lot N, all of Lot 0, and the West 7.5 feet of Lot P, Block 22, City and Townsite of Aspen; and WHEREAS, Lynda MacCarthy as owner of the structures and real property descrlbed as 214 W. Bleeker st., the East 10 feet of Lot N, and the West 20 feet of Lot P, Block 50, City and Townsite of Aspen, have each filed an application for historic landmark designation pursuant to Section 7-701 of the Land Use Code; and WHEREAS, the structures and properties at 716 W. FranC1S st., 620 W. Hallam st., and 214 W. Bleeker st. are all listed in the 1980 Inventory of Historic sites and Structures, as amended in 1986; and WHEREAS, the Historic Preservation Committee recommended historic designation at duly noticed public hearings for 716 W. Francis st. on March 27, 1991, 620 W. Hallam on February 13, 1991, and 214 W. Bleeker on February 27, 1991; and WHEREAS, the Aspen Planning and Zoning commission recommended historic designation at a duly noticed public hearing . e e #334165 07/01/91 14:41 Rec $20.00 8k 6:50 PG 8~...1...2'.' a ...!2"V1~-,-P~ tJ.}J:1. _9r;ty ~l~rL ....!Lo~ t"'pQ_ 282 on Aprll 16, 1991; and WHEREAS, pursuant to section 24-7-702, the city council has found that the Landmark Designation Standards E and F have been met. Each property is a significant component of an historically significant neighborhood and the preservation of each property is critical to the character of the Aspen community; and WHEREAS, City Council wishes to pursue those recommendations and complete the designation process. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the existing structures and properties at: 716 W. Francis st., Lots Nand 0 and the West 15 feet of Lot P, Block 15, City and Townsite of Aspen; and 620 W. Hallam st., the East 1/2 of Lot N, all of Lot 0, and the West 7.5 feet of Lot P, Block 22, city and Townsite of Aspen; and 214 W. Bleeker st., the East 10 feet of Lot N, and the West 20 feet of Lot P, Block 50, Clty and Townslte of Aspen be granted H, Hlstoric Landmark Designation. Section 2 That the Zoning District Map be amended to reflect the rezoning described in Sectlon 1 and the Planning Director shall be authorized and directed to amend said map to reflect said rezoning. 2 . . e #33""165 07/01/91 14 8i 1 vi" ~avi S, P, th ~ 4b Rec $20.00 8f( 6:50 PG 283 ------------ ~~y.-C...l_e!l'LQ.c:l'=__$....9.9_ section 3 That the Planning Director shall be directed to notify the City Clerk of such designation, who shall record among real estate records of the Pitkin County Clerk and Recorder's Office a certified copy of this ordinance. Section 4 That if any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5 That a public hearing on the Ordinance shall be held on the ~ day of 7h~ ' 1991, at 5: 00 p.m. in the City Council Cha:mbers, Aspen City Hall, Aspen, Colorado, fifteen (15) days prior to which hearing notice of the same shall be published once in a newspaper of general circulation within the City of Aspen. 1991.
