AN ORDINANCE OP THE ASPEN CITY COUNCIL GRANTING A RBZONING PROM
COMMERCIAL LODGE (CL) AND LODGB/TOURIST RESIDENTIAL (L/TRl TO PARR
(P) POR LOTS A THROUGH I, BLOCK gl, CITY AND TOWNSITE OF ASPEN
(ALSO KNOWN AS THE NORTHERN PORTION OP LOT 5 OP THE ASPEN MOUNTAIN
SUBDIVISION), THB SOUTliW'EST CORNBR OP EAST DURANT AVENUE AND GALENA
STRBBT, ASPEN COLORADO
WHEREAS, pursuant to Section 24-7-1102 of the Municipal Code the
applicant, Savanah Limi ted Partnership, has submitted an
application for a zoning map amendment for the rezoning of Lots A
through I, Block 91, City and Townsite of Aspen, the southwest
corner of Galena Street and East Durant Avenue, from Commercial
Lodge (CL) and Lodge/Tourist Residential (L/TR) to Park (P); and
WHEREAS, the proposed rezoning is in accordance with the First
Amended and Restated Planned unit Development/Subdivision Agreement
for the Aspen Mountain Subdivision which requires that the subject
parcel be rezoned to the Park zone district; and
WHEREAS, a duly noticed Public Hearing was held by the Aspen
Planning and Zoning Commission (hereinafter "Co=ission") on
September 17, 1991 to consider the map amendment at which time the
Commission reviewed the application; and
WHEREAS, the Commission considered the representations and
commitments made by the applicant and found that the rezoning
application complied with Section 24-7-1102 and was not in conflict
with any applicable portions of Chapter 24 of the Municipal Code,
was consistent with the elements of the Aspen Area Comprehensive
Plan, was compatible with surrounding zone districts and land uses,
was consistent and compatible with the community character in the
city or Aspen, and was in harmony with the purpose and intent of
Chapter 24 of the Municipal Code; and
WHEREAS, the commission has recommended approval to the City
Council for the rezoning of the parcel from Commercial Lodge and
Lodge/Tourist Residential to Park by a vote of 7-0; and
WHEREAS, the city council having considered the Planning and
Zoning Commission's recommendation for a zoning map amendment does
wish to grant the requested map amendment for the southwest corner
of Galena Street and East Durant Avenue, Aspen, Colorado.
NOW, THERBFORB, BE IT ORDAINED BY THE CITY COUNCIL OP THE CITY OF
APEN, COLORADO:

That is does hereby grant rezoning of the southwest corner of
Galena street and East Durant Avenue, Lots A through I, Block 91,
City and Townsite of Aspen, Colorado from Commercial Lodge (CL) and
Lodge/Tourist Residential (L/TR) to Park (P).
Seotion 2:
The Official Zone District Map for the City of Aspen, Colorado,
shall be and is hereby amended to reflect the rezoning action as
set forth in section 1 above and such amendments shall be promptly
entered on the Official Map in accordance with section 24-5-103B
of the Municipal Code.
SlIotioD 3:
The City Clerk is hereby directed, upon the adoption of this
ordinance, to record a copy of this ordinance in the office of the
Pitkin County Clerk and Recorder.

If any section, subsection, sentence, clause, phrase or portion of
this ordinance ie for any reason held invalid or unconstitutuional
by any court of competent jurisdiction, such provision and such
holding shall not affect the validity of the remaining portions
thereof.
Seotion 5:
This ordinance shall not effect any existing litigation and shall
not operate as an abatement of any action or proceeding now pending
under or by virtue of the ordinances repealed or amended as herein
provided, and the same shall be conducted and concluded under such
prior ordinances.
SeotioD 5:
A public hearing on the ordinance shall be held on the 25 day of
November, 1991 at 5:00 P.M. in the City council Chambers, Aspen
City Hall, Aspen, Colorado, fifteen (15) days prior to which
hearing a public notice of the same shall be published one in a
newspaper of general circulation within the City of Aspen.
