Mayor Bennett called the meeting to order at 4:35 p.m. with Councilmembers
Paulson, Markalunas and Richards present.

- Historic Designation & Lot Split 114

Mitch Haas, community development department, said HPC cannot give final
approval for lots splits; this must be done by Council. Haas said this property is
21,161 square feet, zoned R-15A. The proposal is to make two lots, 6,001 square
feet and 15,160 square feet. The allowable FAR will be figured for a duplex and
then spilt between the two lots. The lot with the historic designation can apply for a
500 square foot bonus. Haas said this application meets all the dimensional
requirements of the zone district. Haas noted these lots are prohibited from
applying for any future subdivision. Haas recommended approval with conditions.
John Worcester, city attorney, reminded Council the land use code has been
amended twice recently to allow for historically designated lots to receive lot split in
order to give more incentives to historic landmarks. Worcester said during the
amendment process, everyone thought the approval for these lots splits ended at
HPC. The applicant was lead to believe that HPC granted final approval and timed
the closing of this property based on HPC approval. Worcester said even though
the code amendment had been approved, the city’s Charter requires any burden on
land be approved by ordinance. Because the applicant was mislead, Council agreed
to consider this as an emergency ordinance.
Mayor Bennett opened the public hearing.
Fred Peirce, representing the applicant, told Council a notice of this action was
mailed to all residents within 300 feet and a sign was posted on the property.

Peirce said if there is a slope reduction to FAR, they would like this to go against
the smaller of the 2 lots. Haas said reduction will have to be verified by the city’s
zoning officer. Haas said the reduction applies to the lot which has the slope; this is
not tradable. Worcester said the size of the lot determines the floor area ratio. This
ordinance adopts a lot split, which is drawing a specific lot line to create two parcels
and each parcel has a specific FAR. The FAR for the smaller lot is 1345 square feet
with a possibility of a 500 square foot bonus.
Councilwoman Richards moved to adopt Ordinance #16, Series of 1998, on second
reading as an emergency ordinance; seconded by Councilman Markalunas. Roll call
vote; Councilmembers Paulson, yes; Richards, yes; Markalunas, yes; Mayor
Bennett, yes. Motion carried.
