HomeMy WebLinkAboutordinance.council.058-93 ORDINANCE NO. 58 (Series of 1993) AN ORDINANCE OF THE ASPEN CITY COUNCIL AMENDING THE GROWTH MANAGEMENT DEADLINE FOR COMPETITION IN THE NEIGHBORHOOD COMMERCIAL (NC), COMMERCIAL LODGE (CL), AND SERVICE/COMMERCIAL/INDUSTRIAL (SCI) ZONE DISTRICTS TO CHANGE THE DATE FROM NOVEMBER 15 !TO DECEMBER 31 FOR 1993 COMPETITION ONLY WHEREAS, a consortium of private property owners have been working with the City to create a redevelopment proposal for the city block where City Market, Buckhorn Lodge and Bell Mountain Lodge are located, also known as the Superblock; and WHEREAS, the Superblock encompasses three separate zone districts: Neighborhood Commercial (NC), Commercial Lodge (CL), and Lodge Preservation (LP); and WHEREAS, there are many potential community benefits which may be derived from redevelopment of this block such as municipal parking, significant increase in public open space, and expansion of the NC zone district for local serving businesses; and WHEREAS, city Council (herein after Council) has held many worksessions to review the redevelopment potential of the Superblock concept; and WHEREAS, City Council, finding the September 15 GMP deadline (established in Section 24-8-106 A of the Municipal Code) submittal impractical, moved the deadline to November 15 in order for the private property owners and the City to proceed with their analysis of the proposal, develop a definitive plan, and prepare a GMP application for a project; WHEREAS, the private property owners, due to continued meetings with the City, do not have sufficient time to hire! a 1 planning consultant to prepare an effective GMP application iin time; and WHEREAS, the private property owners have requested lan extension of the November 15, 1993 deadline to December 31, 19913; and WHEREAS, Council directed the Planning Department to move the submittal date for growth management applications for the NC, CL, and S/C/I zone districts from November 15 to December 31; and WHEREAS, Council has directed staff to notify the development community of the change in date in order to afford the same opportunity for other persons considering a development proposal in the NC, CL, and S/C/I zone districts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1: That Section 24-8-106 A of the Municipal Code of the City of Aspen, Colorado, "Annual Submission Dates" relevant to applications for growth management development allotments for "Commercial/Office" development shall be amended so as to add a new and separate application deadline date for developments in the Neighborhood Commercial (NC) , Commercial Lodge (CL) , and Service/Commercial/Industrial (S/C/I) zone districts, such amendments to read as follows: A. Annual submission dates. A development application for a development allotment for the following types of development shall be submitted to the planning director pursuant to Common Procedures, Article 6, Division 2, on or before the following dates. Development Submission Date Tourist Accommodations ................................ August 1 Commerical/Office ................................... September 15 Commercial/Office in NC, CL, S/C/I zone districts .... December 31 Residential .......................................... November 1 Section 2: The amendment to Section 24-8-106 A as provided for in Section 1 above shall apply only to the development allotment competition for commerical/office development in the NC, CL, and S/C/I zone districts for 1993 and the development allotment application deadline of September 15 for commercial/office developments in the NC, CL, and S/C/I zone districts as previously codified at Section 24-8-106 A shall be automatically restored after the conclusion of the 1993 growth management competition. Section 3: The Ordinance shall not be codified. Section 4: If any section, subsection, sentence, clause, phrase or portioniof this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such provision and such holding shall not affect the validity of the remaining portions thereof. Section 5: This Ordinance shall not effect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such 3 prior ordinances. Section 6: A public hearing on the Ordinance shall be held on the,~ dayof ~ 1993 at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen Colorado, fifteen (15) days prior to which a hearing of public notice of the same shall be published in a newspaper of general circulation within the City of Aspen.
