HomeMy WebLinkAboutordinance.council.008-82 ~ c~ BE~OBD OF PROCEEDINGS 100 ~oaves g~ ~ ORDINANCE NO. ~ (Series of ~982) AN ORDINANCE ~ZONING THE L~D CONTAINED WITHIN THE GOLF COURSE SUBDIVISION WHEREAS, the City of Aspen is the owner of approximately 186 acres of real property, commonly known as the Golf Course Property and which is more specifically described in Exhibit "A" attached hereto and incorporated herein; and WHEREAS, said real property is currently zoned P-Park, with a portion of the zone also having a transportation overlay; and WHEREAS, the lodge located on said real property, commonly known as the "Plum Tree Inn", is currently permitted as a non-con- forming use; and WHEREAS, the City Council desires to rezone the aforesaid property such that the continued existence, operation and use of a lodge thereon shall be permitted; and WHEREAS, the Aspen Planning and Zoning Commission did con- sider at a public hearing held on January 19 and February 2, 1982, an application for Preliminary Plat Subdivision, subdividing the property into Lots 1 and 2, as they appear on the subdivision plat attached hereto and incorporated herein as Exhibit "B", as well as an application for rezoning of these parcels; and WHEREAS, on February 2, 1982~ the Planning and Zoning Co, is- sion did approve the Golf Course Preliminary Plat Subdivision with the reco~endation that City Council rezone the parcel upon which the lodge is located (Lot "2") as P-Park with a Golf Course Sup- port Overlay and the remaining land comprising the Golf Course itself (Lot "1") as P-Park; and WHEREAS, the Aspen City Council does desire to accept and implement the reco~endations of the Aspen Planning and Zoning Co~ission. RECORD OF PROCEEDINGS 100 Leaves Now, THEREFORE, BE I~ ORDAIRED BY T~E C[~¥ COUNC[~ OF ~BE C[~¥ OF AS2E~ COGORADO= Section 1 That from and after the effective date of this ordinance, the property described and designated as Lot 1 on Exhibit "B", attached hereto and incorporated herein, shall be zoned P-Park, and shall be subject to those zoning regulations applicable to said zone district and described in Chapter 24 of the Aspen Muni- cipal code (as now exists or may hereafter be amended). Section 2 That from and after the effective date of this ordinance, the property described and designated as Lot 2 and Golf Course Support Area on Exhibit "B", attached hereto and incorporated herein, shall be zoned P-Park with a Golf Course Support Overlay, and shall be subject to those zoning regulations applicable to said zone district and described in Chapter 24 of the Aspen Muni- cipal Code (as now exists or may hereafter be amended). Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinet and independent provision and shall not affect the validity of the remaining portions thereof.
