(Series of 1982)
AN ORDINANCE AMENDING ORDINANCE NO. 91, SERIES OF 1981, BY
ADDING AN APPROPRIATION FOR A TRANSFER TO THE CASTLE RIDGE
FUND ($45,000), EMPLOYEE RETIREMENT FUND EXPENDITURE AND
REVENUES ($27,000 EACH), ICE GARDEN FUND EXPENDITURES
($9,000), WATER FUND DEBT SERVICE EXPENDITURES FROM CURRENT
YEAR FUND BALANCE ($140,000), WHICH APPROPRIATIONS WERE
INADVERTENTLY DELETED FROM SAID ORDINANCE
WHEREAS, it has come to the attention of the City Council
that an appropriation for a transfer from Electric Fund to the
Castle Ridge Fund ($45,000), Employee Retirement Fund Revenues and
Expenditures ($27,000 each), Ice Garden Fund Expenditures
($9,000), and Water Fund Expenditures for debt service ($140,000)
were inadvertently deleted from the provisions of Ordinance No.
91, Series of 1981, and
WHEREAS, it was the intention of the City Council to author-
ize the aforesaid appropriations at the time Ordinance No. 91,
Series of 1981, was passed, and
WHEREAS, the City Council desires to amend Ordinance No. 91,
Series of 1981, so as to accurately reflect the intention of the
City Council with regard to the aforesaid appropriations, and
WHEREAS, the City Manager has certified that as of the date
of the passage of Ordinance No. 91, Series of 1981, revenues and
funds in excess of those estimated in the budget were available
for appropriation,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the title of Ordinance No. 91, Series of 1981, be
amended by adding the following: "AN ORDINANCE AMENDING ORDINANCE
NO. 91, SERIES OF 1981, BY ADDING AN APPROPRIATION FOR A TRANSFER
TO THE CASTLE RIDGE FUND ($45,000), EMPLOYEE RETIREMENT FUND
RECORD OF PROCEEDINGS 100 Leaves
EXPENDITURES ~ND REVENUES ($27,000 EACH), ICE GARDEN FUND EXPENDI-
TURES ($9,000), WATER FUND DEBT SERVICE EXPENDITURES FROh CURRENT
YEAR FUND BALANCE ($140,000)."
Section 2
That Section 1 of Ordinance No. 91, Series of 1981, be
amended by inserting the following language after the language
"Appropriating $180,000 of Water Bond Proceeds" and before the
language "for the purposes specified in Exhibit "A".
"An ordinance amending Ordinance No. 91, Series of 1981, by
adding an appropriation for a transfer to the Castle Ridge
Fund ($45,000), Employee Retirement Fund Expenditures and
Revenues ($27,000 each), Ice Garden Fund Expenditures
($9,000), and Water Fund Debt Service Expenditures from cur-
rent year fund balance ($140,000)."
Section 3
That Exhibit "A" be annexed to Ordinance No. 91, Series of
1981, be amended by the addition of the aforesaid appropriations
for the purposes specified in the amended Exhibit "A" which is
annexed hereto and made a part hereof.
Section 4
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 5
A public hearing on the ordinance shall be held on the
