ORDINANCE NO. 9/2~__) (Series of 1
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE ON
BEHALF OF THE CITY OF ASPEN A WATER RIGHTS LEASE WITH LOMA ALTO
CORPORATION CONCERNING WATER RIGHTS IN THE RIVERSIDE DITCH
WHEREAS, to induce the City to annex into the City of Aspen
that property commonly known as Lots 1, 2, 3 and 4, Ferguson
Exemption Plat, located in Pitkin County, Colorado, the Loma Alto
Corporation has agreed to convey to the City of Aspen all water
rights attendant to said parcel; and
WHEREAS, the City Council desires to enter into the annexed
Water Rights Lease with Loma Alto Corporation and desires to
authorize the Mayor to execute the same on behalf of the City of
Aspen.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council hereby approves the terms and condi-
tions of the attached Water Rights Lease between the City of Aspen
and Loma Alto Corporation and authorizes and directs the Mayor to
execute the same on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.

A public hearing on the ordinance shall be held on the/~~'~(~
