HomeMy WebLinkAboutordinance.council.020-82 RECORD OF PROCEEDINGS 100 Leaves o~ ~o. ~ (~=&es o~ ~982) AN ORDINANCE VACATING PORTIONS OF A 16 FOOT PUBLIC RIGHT OF WAY RESERVED BY DOCUMENT OF RECORD AT BOOK 193 PAGE 320 OF THE RECORDS COUNTY COURTHOUSE WHEREAS, the City of Aspen has received a petition by the Board of County Commissioners to vacate a certain reserved right of way adjacent to the Courthouse, and WHEREAS, the City Council has found and determined with respect thereto that: 1. The right of way was reserved by deed dated February 15, 1961 of record at Book 193 Page 320 of the records of the Pitkin County Clerk and Rcorder. No roadway improvements (or utilities) have been placed within the right of way nor has the same been used for accesss or any other public purpose. 2. The vacation will leave no land adjoining said roadway with- out an established public road connecting said land with another established public road. 3. No utilities have been placed within the right of way nor is there any need to reserve easements for said purpose. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aspen, Colorado: Section 1 That it does hereby vacate that 16 foot right of way reserved for roadway purposes in the deed of record at Book 193 Page 320 as the same crosses the following described real property: A parcel of land situated in Section 7, T10S, R84W of the 6th PM, Pitkin County, Colorado, being more fully described as follows: Beginning at a point whence the southwest corner of Lot K, Block 92 City of Aspen, Colorado, bears S14°50'44"W 240.06 feet. - 1 - RECORD OF PROCEEDINGS 100 Leaves Thence N14°50'49"E, 55.57 feet; Thence S75°90'11"E, 180.57 feet; Thence S84°34'00"W, 115.55 feet; Thence N87°17'00"W, 73.83 feet; To the point of beginning containing 5621 square feet more or less. Section 2 If any provisions of this ordinance on the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. (Series of 1982) AN ORDINANCE VACATING PORTIONS OF A 16 FOOT PUBLIC RIGHT-OF-WAY RESERVED BY DOCUMENT OF RECORD AT BOOK 193 PAGE 320 OF THE RECORDS OF THE PITKIN COUNTY CLERK AND RECORDER AND ADJACENT TO THE PITKIN COUNTY COURTHOUSE WHEREAS, the City of Aspen has received a petition by the Board of County Commissioners to vacate a certain reserved right- of-way adjacent to the Courthouse, and WHEREAS, the City Council has found and determined with respect thereto that: 1. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That it does hereby vacate that 16 foot right-of-way excepted in the deed in Page 193 at Page 320, said vacated right-of-way being described as follows: A parcel of land situated in Section 7, Township 10 South, Range 84 West of the 6th Principal Meridian, being bounded as follows: On the South by Pitkin County Courthouse property; On the North by the City of Aspen Rio Grande Property as described in Book 279 at Page 745; On the East by the Easterly lot boundary of Lot 6, Block 19, East Aspen Townsite; RECORD OF PROCEEDINGS 100Leaves On the West by the East right-of-way boundary of Galena Street as shown and located on the official map of the City of Aspen approved by Ordinance No. 6, Series of 1959, recorded in Book 189 at Page 354. The above-mentioned documents are recorded in the Office of the Pitkin County Clerk and Recorder. The above-described vacated right-of-way lies wholly within the bounds of the Pitkin County Center Subdivision. Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
