HomeMy WebLinkAboutordinance.council.030-82 RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~f~ (Series of 1982) AN ORDINANCE ESTABLISHING NEW COMPLIANCE DATES AND ENFORCEMENT PROVISIONS FOR MANDATORY METERING OF MUNICIPAL WATER SERVICE, ALL BY AMENDING SECTION 23-104 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO WHEREAS, in order to preserve and properly allocate the water resources of the municipal water system of the City of Aspen, the City Council of the City of Aspen has determined that mandatory metering of water customers is in the best interest of the City; and WHEREAS, it is necessary to the administration of the manda- tory metering system that compliance dates for meter installation be set and enforcement provisions be enacted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Sections 23-104(c), (d) and (e) of the Municipal Code of the City of Aspen, Colorado, be repealed and reenacted to read as follows: "(c) All commercial water customers, whether served by pump stations or gravity feed, shall convert to metered ser- vice as provided herein on or before November 1, 1982. (d) All other water customers served by pump stations, in- cluding residential customers, shall convert to metered service as provided herein on or before June 1, 1983. (e) All remaining water customers of the water system shall convert to metered service as provided herein on or before June 1, 1984." Section 2 That a new Section 23-I04(g) be added to the Municipal Code of the City of Aspen, Colorado, to read as follows: "(g) It shall be unlawful for any'person to be in violation of this Section and each day such person is in violation may be deemed a separate offense." RECORD OF PROCEEDINGS 100 Leaves Section 3 That a new Section 23-104(h) be added to the Municipal Code of the City of Aspen, Colorado, to read as follows: "(h) In addition to all other remedies provided by this Sec- tion or this Code for violation of this Section, if a person is in violation of this Section the manager shall disconnect the water service to any such person and shall not reconnect said service until such person shall come into compliance with this Section and also shall pay full costs of said disconnection and such other costs and fees related to water service (deposits, water service charges, plant investment fee, metering charges) as may be due." Section 4 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such ~rtion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining por- tions thereof.
