ORDINANCE NO.
(Ser~es of 1982)
AN ORDINANCE AMENDING SECTIONS 24-11.4, 24-11.5 and 24-11.6 OF THE
ASPEN MUNICIPAL CODE CONCERNING THE ANNUAL DATE FOR THE SUBMISSION
AND PROCESSING OF RESIDENTIAL, COMMERCIAL AND LODGE DEVELOPMENT
APPLICATIONS
WHEREAS, pursuant to Section 24-11.4 of the Aspen Municipal
Code, January 1st is the annual submission date for residential
development applications, and
WHEREAS, pursuant to Section 24-11.5 of the Aspen Municipal
Code, September 1st is the annual submission date for commercial
development applications, and
WHEREAS, pursuant to Section 24-11.6 of the Aspen Municipal
Code, September 1st is the annual submission date for lodge devel-
opment applications, and
WHEREAS¢ the Planning Office has identified various proce-
dural and timing difficulties for applicants, staff and the Plan-
ning Commission associated with the annual dates for the submis-
sion of development applications, and
WHEREAS, at a public hearing on September 28, 1982, the Aspen
Planning and Zoning Commission did consider a revised set of
annual dates for the submission of development applications and
did recommend that the City Council adopt the dates for submission
of development applications which were recommended by the Planning
Office, and
WHEREAS, the Aspen City Council does wish to accept the
recommendation of the Aspen Planning and Zoning Commission and
adopt the dates for submission of development applications which
were recommended by the Planning Office.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:

Section 1
That Section 24-11.4(a) entitled "Residential Development
Application Procedure" be and the same is hereby amended by the
elimination of the date "January 1st" and its replacement by the
date "December 1st".
Section 2
That Section 24-11.4(b) is hereby amended by the elimination
of the words "during the early weeks of January and their replace-
ment by the words "during the early weeks of December" and by the
elimination of the words "no later than February 1st of each year
or at the Commission's first regular meeting subsequent to that
date" and their replacement by the words "at a regular meeting of
the Commission during January".
Section 3
That Section 24-11.4(d) is hereby amended by the elimination
of the words "on or before March 1st of each year" and their
replacement by the words "on or before February 1st of each year".
Section 4
That Section 24-11.4(g) is hereby amended by the elimination
of the words "and prior to April 1st of each year" and their
replacement by the words "and prior to March 1st of each year".
Section 5
That Section 24-11.5(a) entitled "Commercial Development
Application Procedure" be and the same is hereby amended by the
elimination of the date "September 1st" and its replacement by
the date "August 1st".
Section 6
That Section 24-11.5(b) is hereby amended by the elimination
of the words "during the early weeks of September" and their
replacement by the words "during the early weeks of August" and by

the elimination of the words "no later than October 1st of each
year or at the Commission's first regular meeting subsequent to
that date" and their replacement by the words "at a regular meet-
ing of the Commission during September".
Section 7
That Section 24-11.5(d) is hereby amended by the elimination
of the words "on or before November 1st of each year" and their
replacement by the words "on or before October 1st of each year".
Section 8
That Section 24-11.5(f) is hereby amended by the elimination
of the words "and prior to December 1st of each year" and their
replacement by the words "and prior to November 1st of each year".
Section 9
That Section 24-11.6(a) entitled "Lodge Development Applica-
tion Procedure" be and the same is hereby amended by the elimina-
tion of the date "September 1st" and its replacement by the date
"October 1st".
Section 10
That Section 24-11.6(b) is hereby amended by the elimination
of the words "during the early weeks of September" and their
replacement by the words "during the early weeks of October" and
by the elimination of the words "no later than October 1st of each
year or at the Commission's first regular meeting subsequent to
that date" and their replacement by the words "at a regular meet-
ing of the Commission during November".
Section 11
That Section 24-11.6(d) is hereby amended by the elimination
of the words "on or before November 1st of each year" and their
replacement by the words "on or before December 1st of each year".

Section 12
That Section 24-11.6(f) is hereby amended by the elimination
of the words "and prior to December 1st of each year" and their
replacement by the words "and prior to January 1st of each year".
Section 13
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitu~tional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 14
A public hearing on the ordinance shall be held on the
day of ~ , 1982, at 5:00 P.M. in the City Council
Chambers, Aspen City Hall, 130 South Galena Street, Aspen,
Colorado, 15 days prior to which hearing notice of the same shall
be published once in a newspaper of general circulation within the
City of Aspen.

the City Council of the City of Aspen, Colorado, at its regular
