(Series of 1982) AN ORDINANCE BY THE CITY COUNCIL OF ASPEN, COLORADO, CERTIFYING TO THE TREASURER OF PITKIN COUNTY, COLORADO, CERTAIN DELINQUENT MUNICIPAL UTILITY CHARGES OWING TO THE .CIT_Y OF ASPEN FOR COLLECTION WITH COUNTY PROPERTY TAXES, PURSUANT TO SECTION 31-20-105, COLORADO REVISED STATUTES (C.R.S.) ~973, AS ~ENDED WHEREAS, the City of Aspen, Colorado, through its electric and water departments has certain delinquent customer accounts; and WHEREAS, the City has made all reasonable efforts to collect these delinquent accounts short of legal action; and WHEREAS, the Municipal Code of the City of Aspen by Sections 23-22 and 23-106, permits collection of delinquent electric and water charges by lawsuit, or lien, or both; and WHEREAS, state law, by Sections 31-20-101 et seq., C.R.S. 1973, as amended, provides that delinquent municipal utility charges may be certified by the municipality to the county trea- surer, whose duty is thereupon to collect such delinquent charges in the same manner as county property taxes are collected; and WHEREAS, the City Council has determined that it is in the best interests of the City to reduce its delinquent utility accounts by collection in this manner as provided by law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That all of the delinquent electric and water utility accounts receivable by the City of Aspen, as listed on Exhibits "A" and "B", copies of which are attached hereto and incorporated herein by reference, be and hereby are certified to the Treasurer of Pitkin County, Colorado, for collection with county property taxes, in such cases made and provided by law including, without RECORD OF PROCEEDINGS 100 Leaves limitation, Section 31-20-101 et seq., C.R.S. 1973, as amended, and Sections 23-22 and 23-106, Aspen Municipal Code, as amended. Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 3 A public hearing on the ordinance shall be held on the~ day of ~ , 1982, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
