ORDINANCE NO.7
Series of 1995
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
TO REPEAL SECTION 15-5 OF THE ASPEN MUNICIPAL CODE RELATING TO THE
APPOINTMENT AND DUTIES OF THE MUNICIPAL COURT CLERK.
WHEREAS, section 15-5 of the Municipal Code authorizes the municipal court judge
to appoint a municipal court clerk and to assign to the court clerk the duties of that position;
and
WHEREAS, Section 15-5 of the Municipal Code authorizes the city council to
determine the annual salary of the city clerk; and
WHEREAS, Section 15-5 of the Municipal Code purports to authorize the municipal
court clerk to collect moneys on behalf of the municipal court; and
WHEREAS, the City Council deems it to be in the best interest of the City that the
city manager have the authority to appoint the municipal court clerk, assign to the clerk the
duties of that position, and to require all payments made to the municipal court to be
collected by the finance department.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
Section 1
Section 15-5 of the Municipal Code of the City of Aspen, Colorado, is hereby
repealed.

Section 2
This ordinance shall not have any effect on existing litigation and shall not operate as
an abatement of any action or proceeding now pending under or by virtue of the ordinances
repealed of amended as herein provided, and the same shall be construed and concluded
under such prior ordinances.
Section 3
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and shall not affect the
validity of the remaining portions thereof.
A public hearing on the ordinance shall be held on the a day Of~ >-
1995, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
