Council August 4, 2003 Mayor Klanderud called the special meeting to order at 5:05 p.m with Councilmembers Torre, Semrau, Paulson and Richards present. ORDINANCE #36~ SERIES OF 2003 - Burlingame Parcel D Affordable Housing Julie Ann Woods, community development department, reminded Council issues came up at the public heating last week and discussions have been held between staff and the owner of the ABC. John Worcester, city attorney, told Council the agreements reached with John McBride include that the one structure on the old Qwest property will be lowered to 30 feet with the understanding the ABC architectural review board will look at the current plans to see if they can be approved as is. If the architectural review board does not like the plans, the city agrees to lower the building to 30 feet. The city agrees to deed restrict the larger Burlingame Ranch parcel to forever preclude the construction of a vehicular road on the backside of Deer Hill Worcester reminded Council they looked at this and felt the costs and environmental damage would be prohibitive. The city does want the ability to build a trail that would also accommodate golf carts. The city will agree ro McBride's interpretation of an old water agreement and will reimburse McBride $35,000 as partial payment of a water line. Worcester told Council McBride argues that ABC has constructed a lot of public amenities like trails, sidewalks and roads. The city recogmzes their project will use some of these amenities and will reimburse the ABC $20,000 upon receiving a building permit. Worcester said McBride is concerned about damage that may occur to Ventor Avenue during construction. This is a county road and not up to county standards. The city has paid a road impact fee to Pitkin County of $105,000 with no guarantees that that money will be used to repair Ventnor Avenue. The agreement with McBride is that the city will restore Ventnor to its current condition after construction. Worcester said McBride would prefer the city look into the feasibility of a temporary construction access to the project on the proposed trail alignment off highway 82. Worcester said the big issue is whether CDOT will allow this temporary access. Special Meeting Aspen Ci~, Council August 4~ 2003 Worcester told Council McBride would like priority be given to people who work at the ABC to purchase these homes. Worcester said this would require a formal amendment to the housing authority guidelines, which would require approval from the housing board, the BOCC and City Council. If Council agrees to this agreement, they are merely stating they will get the process started. Councilwoman Richards asked if there is an estimate for the temporary access road offhighway 82. Worcester said this alignment would be the same as the trail. Ed Sadler, assistant city manager, said the issue is traffic control; the access road will be crossing a trail and will be exiting onto the highway and there will be costs in hiring taggers. Councilman Paulson asked if Council agrees to all these conditions, is this project approved. John McBride told Council the ABC architectural review committee is meeting tomorrow to review the building on the land under ABC purview. Councilman Semrau asked if Council would approve the temporary access road if CDOT approves it no matter what the cost. Worcester said he thought the fatal flaw was CDOT approval and had not considered the costs of this condition. McBride said he would like to see a permanent road at this location. Councilman Semrau asked if the temporary access road is only for heavy construction traffic or is meant for all traffic. McBride said he would prefer it for all traffic. Councilman Semrau said it is a good idea and if can be done affordably, the city should do it. Councilman Semrau said if it will cost more than $50,000, the city cannot do it. Mayor Klanderud noted her concern is this will be never ending. The city needs to proceed building this project and it may take 8 months to get CDOT approval. Mayor Klanderud said she would feel more comfortable with this issue if she knew the costs before approval. Mavor Klanderud stated there were 6 business representatives from the ABC on the COWOP and these issues are coming up at the last minute. Mark representing two buildings at the ABC using Ventnor Avenue, told Council there are 30 commercial and 10 residential tenants who will be affected by additional traffic on Ventnor. Adding any trips will overload Ventnor. Taylor Sweet, Design Workshop, told Council is takes 4 or 5 months to get a response from CDOT. Doug Graybeal, architect for the Special Meeting Aspen CiW, Council AugUst 4, 2003 project, said he is concerned about the ABC architectural review and trying to keep this prOject on schedule. Councilman Semrau said condition #7 can be initiated and taken through the process as a concurrent review and not hold up the project. Councilman Semrau said the temporary access, if feasible, is a good idea. Lennie Oates, representing the ABC, said the city has to be willing to absorb some incremental costs. Mayor Klanderud pointed out the city is agreeing to $20,000 for ABC improvements. Councilman Semrau said the city is committed to some incremental costs to save money on post construction repairs to Ventnor Avenue: McBride said these are requests for the city to become good neighbors as part of building at the ABC: McBride said he feels it is important that the people who work at the ABC get first chance at living in these units. Mayor KlanderUd asked if there is a commitment when the city will get architectural approval from the ABC review. Councilman Semrau asked if the review for the one building under ABC purview can be split off and the rest of the project go ahead. Graybeal told Council their schedule requires submitting for building permit as soon as possible. Councilman Semrau asked if the revieTM committee is meeting tomorrow if the city could have their recommendations by tomorrow. Graybeal told Council if this project were to follow the strict outline of ABC's covenants, the building will not conform. There is flexibility but it is very subjective. Worcester said if the ABC states the city cannot build their proposed design of the one building on ABC controlled property, then there is no deal with the issues outlined. The ABC still has review Over the driveway. Councilwoman Richards said she would prefer to approve this contingent upon ABC's design review and approval with minimal changes to the city's project. Councilwoman Richards said if the changes are more than minimal, she would eliminate one building in favor of building 33 units. Councilman Semrau moved to approve the agreement as outlined in the memorandum from the city attorney dated AugUst 4, 2003; seConded by Councilwoman Richards. All in favor, motion carried. 3 Special Meeting Aspen City Council August 4, 2003 Councilman Semrau moved to continue Ordinance #36, Series of 2003, and to continue the meeting to August 5 at 4:00 p.m.; seconded by Councilwoman Torre. All in favor, motion carried. VISITOR CENTER COWOP Council voted to appoint Jimmy Yeager, Willis Pember, Gaelin Smith and Tim Belinski as citizen represematives to the COWOP. The Civic Master Plan committee representative will be Bennett Branson. The Council representative will be Helen Klandemd. Councilman Paulson moved to ge into executive session at 6:00 p.m. pursuant to C.R.S. 24-6-402(4)(b) confer with counsel and discuss negotiations; seconded by Councilwoman Richards. All in favor, motion carried. Councilwoman Richards moved to come out of executive session at 6:30 p.m.; seconded by Councilman Torre. All in favor, motion carried.
