Mayor Klanderud called the continued meeting to order at 4:05 p.m. with
Councilmembers Semrau, Paulson, Richards and Torre present.
Councilwoman Richards moved to go into executive session pursuant to
C.R.S 24-6-402(4)(b) to receive advice from counsel; seconded by
Councilman Paulson. All in favor, motion carried.
Councilman Semrau moved to come out of executive session at 5:45 p.m.;
seconded by Councilman Torre. All in favor, motion carried.
ORDINANCE #36, SERIES OF 2003 - Burlingame Ranch Lot 3
Ed Sadler, assistant city manager, pointed out that the Qwest parcel cuts
through 90% of building A. Sadler told Council the ABC architecture
rewew committee met today. No city representatives were allowed at the
meeting. The project model was sent to the committee meeting. Sadler
went through his memorandum of answers to John McBride's memorandum
of August 5, 2003.
Save trees on the north side of the site. Sadler told Council the parks
department comments these trees are too large to transplant. If the building
on the Qwest parcel is eliminated, most of these trees will be saved.
Request the Iowest floor of Building A be no higher than 2 feet above the
first floor of building 210 across the street. Sadler said staff has no
elevations on the 210 building so cannot comment on this.
Plans are different than the model. Sadler said the plans are different and the
model was a conceptual idea of the project.
Sadler noted the request from ABC is to open up the building and to
eliminate the stair tower. Sadler said option I decreases the project to 39
units. ASW proposed the stair tower be more open and staff said it should
stay enclosed as shown on the model, which will be better in winter weather.
If the stair tower is not a major issue to Council, ASW can open it up, keep
than one unit and drop the rest of the building below 30 feet.
The ABC review board stated the roof must be black, which is fine with flat
roof design. With raised roofs, the black makes the roof more visible, and

there is a heat loading issue. Sadler said it would look peculiar to make one
roof in the complex black.
Another comment was that the windows should align vertically where
possible. Sadler told Council the windows are in the same position for each
unit but since the levels step up the hills, the windows are offset. The
windows will be white clad and trimmed to match the rest of the building.
Sadler stated the housing specs say either the windows or the siding have to
be low maintenance. The windows in this project are unpainted and are
meant to be white clad; this helps with UV protection. Doug Graybeal,
architect, told Council they chose white because of the way it offsets the
building and also makes it look like a residential project rather than a
commercial project.
The ABC review board approved the siding but did not approve the colors.
Mayor Klanderud said when Council accepted the project; they accepted the
colors and the look. Sadler said if staffhad been at the review board
meeting, they would have made it clear this was the look Council was after.
The review board stated the guest parking for Building A is not at Building
A and it is important to the committee this be clearly signed. Sadler said
this could be taken care of with signs.
Sadler noted the subject of trees comes up again. Council has added a.lot of
trees to the project and if they want more, more will be planted. Sadler
showed where there will be heavy planting to screen the project from the
highway and from BMC.
The Review Board stated there should be a better access at the south end of
ABC. Sadler said he does not think this is w/thin their purview. The Board
also noted this project should be folded into and made part of the ABC.
Sadler said the majority of this project is city land. A homeowner's
association will maintain the project. The Board suggested a better identifier
than parcel d and Sadler said it is actually lot 3.
Mayor Klanderud noted there is nothing in the letter of McBride that assures
the city that with these changes; the ABC gives their approval. Council
needs to decide whether to eliminate the building on the Qwest property or
to see if they can work this out with McBride. Either will take time and put
the project behind schedule, up to two months. CJraybeal said his preference

would be to work out the issues with the ABC and to continue with the
current design. It is the best presence with the ABC. Mayor Klanderud
stated some of these are open-ended reqmrements and this might keep going
and going. Councilman Semrau agreed; the decision is to eliminate one
building or to try and work out the conditions with the ABC.
Councilwoman Richards said Council looked at another set of conditions
last night and if the city goes ahead with two buildings, they may be making
commitments without ever getting approval for the 7 units. John Worcester.
city attorney, told Council McBride stated he does not want to delay the
project and wants to work this out. Council can go ahead with their
approvals.
Councilman Semrau moved to adopt Ordinance #36, Series of 2003, on
second reading; seconded by Councilman Paulson.
Councilman Torre said he would prefer not to lose the 7 units.
Roll call vote: Councilmembers Semrau, yes; Richards, yes; Paulson, yes;
Torre, yes; Mayor Klanderud, yes. Motion carried.
CoUncilman Torre moved to adjourn at 6:55 p.m.; seconded by
Councilwoman Richards. All in favor, motion carded.
