(Series of 1995)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
TO AMEND SECTION 23-44(a) (4) OF THE MUNICIPAL CODE RELATING TO
EQUIVALENT CAPACITY UNIT CALCULATIONS FOR IRRIGATION, AND TO
AMEND SECTION 23-71 OF THE MUNICIPAL CODE TO CODIFY ORDINANCE NO.
27 (SERIES OF 1995), WHICH ESTABLISHED A SCHEDULE FOR PARTIAL TAP
FEE WAIVERS FOR MIXED FREE MARKET AND AFFORDABLE HOUSING PROJECTS
IN AH ZONE DISTRICTS.
WHEREAS, the city of Aspen, COlorado, is a home rule city
pursuant to Article XX of the Constitution of the State of
Colorado, vested with authority and power to establish rates and
charges for the delivery of water through its municipal water
system; and
WHEREAS, the City Council desires to ,amend the method for
computing Equivalent Capacity Units (ECU's) for irrigation; and
WHEREAS, the city Council desires to codify Ordinance No. 27
(Series of 1995) relating to the establishment of a schedule for
partial tap fee waivers for mixed free-market and affordable
housing projects in AH zone districts.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:

addition of a subsection (e) which subsection shall read as fol-
lows:

units. The unit category classifications refer to the
classifications of the Aspen-Pitkin Housing Authority
as now in effect and as may hereafter be amended.

This ordinance shall not have any effect on existing litiga-
tion and shall not operate as an abatement of any action or
proceeding now pending under or by virtue of the ordinances
repealed or amended as herein provided, and the same shall be
construed and concluded under such prior ordinances.

If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
