ORDINANCE NO. 22
(Series of 1997)
AN ORDINANCE OF THE CITY COUNCIL, OF THE CITY OF ASPEN,
COLORADO, WAIVING THE PARK DEDICATION FEES FOR THE
APPROVED REDEVELOPMENT OF 303 E. MAIN STREET, PURSUANT TO
SECTION 26.44.060 OF THE ASPEN MUNICIPAL CODE.
WHEREAS, Niklaus Kuhn, owner of 303 E. Main Street, Lots A and the
west half of Lot B, Block 80, City and Townsite of Aspen, requests waiver of
park dedication fees for the approved redevelopment of said property, pursuant
to Section 26.44.060 of the Municipal Code; and
WHEREAS, the park dedication fees required are in the amount of
$2725.00; and
WHEREAS, City Council wishes to encourage the preservation of historic

landmarks by offering incentives to the property owner.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1
That park dedication fees for the approved redevelopment of the property at:
303 E. Main Street, Lot A and the west half of Lot B, Block 80, City and
Townsite of Aspen
be waived, in the amount of $2725.00, pursuant to Section 26.44.060 of the
Municipal Code
Section 2
That if any section, subsection, sentence, clause, phrase, or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the
remaining portions thereof.

A public hearing on the Ordinance was held on the :L..day of at 5:00
p.m. in the City Council Chambers, Aspen City Hall, Aspen olorado, fifteen
(15) days prior to which hearing notice of the same was published once in a
newspaper of general circulation within the City of Aspen.
INTRODUCED, READ, AND ORDERED PUBLISHED as provided by law by the
City Council of the City of Aspen on the 27th day of May, 1997.
