AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, AMENDING THE 1995 EDITION OF THE
"MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES,"
BY,THE AMENDMENT AND ADDITION OF SUBSECTIONS.

WHEREAS, the City Co.uncil o.f the City o.f Aspen previo.usly ado.pted the 1995
editio.n o.f the "Mo.del Traffic Co.de fo.r Co.Io.rado. Municipalities" with additio.ns,
mo.dificatio.ns, and penalties, and '

WHEREAS, the Mo.del Traffic Co.de o.f 1995, as amended, has been co.dified by
reference as Sectio.n 24.04.020 o.fthe Municipal Co.de o.fthe City o.f Aspen, and
~EREAS, the City Co.uncil desires to. ado.pt fo.r the benefit o.f the City o.f Aspen
the fo.llo.wing amendments and additio.ns to. the Mo.del Traffic Co.de o.f 1995.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
Sectio.n 1. Ado.ptio.n.
The 1995 editio.n o.f the "Mo.del Traffic Co.de for Co.Io.rado. Municipalities," as
amended, was ado.pted by the Aspen City Co.uncil as Ordinance No.. 28, Series o.f

1996, o.n August 12: 1996. The subject matter o.fthe Mo.del Traffic Co.de relates
primarily to. co.mprehensive traffic co.ntro.I regulatio.ns fo.r the City. The purpo.se
o.f artunldments ado.pted herein is to. further pro.vide a system o.f traffic regulations

co.nsistent with state law and generally co.nfo.rming to. similar regulatio.ns
thro.ugho.ut the state and the natio.n. Three (3) co.pies o.fthe Mo.del Traffic Co.de are
filed in the o.ffice o.f the Clerk o.f the City 'o.f Aspen, Co.Io.rado., and may be inspected
during regular business hours.
Sectio.n 2. Text o.f Amended Ordinance.
That Sectio.n 24.04.020(b), Mo.del Traffic Co.de, o.fthe Municipal Co.de o.fthe City
o.f Aspen, Co.Io.rado., is hereby amended by the additio.n o.f the fo.llo.wing sectio.ns:
(10) Subsectio.n (10) is hereby repeated in its entirety and reenacted to. read as fo.llo.ws:
Sectio.n 1217.' The Mo.del Traffic Co.de is hereby amended by the addition o.fSectio.n
1217, which shall read as fo.llo.ws:
Parking fo.r certain purpo.ses pro.hibited. No. perso.n shall park a vehicle UPo.n a
roadway fo.r the principal purpo.se o.f:
(a) Displaying such vehicle fo.r sale;
(b) Washing, greasing, painting, o.r repairing such vehicle except repairs necessitated
by an emergency; ,

(c) Displaying advertising.
(15) Sectio.n 613. The Mo.del Traffic Co.de is hereby amended by theadditio.n o.fSectio.n'
613, which shall read as fo.llows:'
Obedience to. sto.Pping, standing, o.r parking regulatio.ns. On any street or at any place
within the municipality where o.fficial signs are Po.sted giving no.tice o.f sto.Pping,
standing, or parking restrictio.n~ o.r prohibitio.ns, no. pet:so.n shall sto.P, stand, o.r park
a vehicle in any manner in vio.latio.n o.f the pro.visio.ns co.ntained o.n such sign o.r signs
except when necessary to. avo.id Co.nflict with o.ther traffic, o.r in co.mpliance with the
directio.ns o.f a Po.lice qfficer, parking officer, o.r o.fficial traffic co.ntro.I device or except
fo.r the purpo.se o.f the necessary and expeditio.us Io.ading o.r unlo.ading passengers when
such standing,do.es no.t o.bstruct, impede o.r endanger any traffic.

(16) Sectio.n 1415: The Mo.del Traffic Co.de is hereby amended by the additio.no.f
Sectio.n 1415, which shall read as fo.llo.ws:
Vio.latio.n o.f registratio.n pro.visio.ns. It is unlawful fo.r any perso.n to.:
To. park, o.r fo.r the o.wner o.r o.perator thereo.f kno.wingly to. permit the parking UPo.n a
street o.r property o.f the City o.f Aspen, 0.1 any vehicle o.r trailer co.ach subject to.
registratio.n under the laws o.f the State o.f Co.Io.rado. o.r the laws o.f any o.ther
jurisdictio.n, which is no.t registered pursuant to. Co.Io.rado. law o.r which do.es no.t have
attached thereto. and displayed thereo.n the number plate o.r plates assigned thereto. by
the department fo.r the current registratio.n year. This sectio.n do.es not apply to.
vehicles o.r trailer co.aches with dealer plates o.r depo.t tags displayed in acco.rdance
with laws applicable to. such use fo.r mo.to.r vehicle dealers and manufacturers.
(17) Sectio.n 1204(1). Mo.del Traffic Co.de Sectio.ns 1204(1)(1) and 1204(1)(k) are hereby
repealed and reenacted to. read as fo.llo.ws:
(1) In alleyways, truck Io.ading zo.nes, and passenger Io.ading zo.nes except during the,
. necessary and expeditio.us Io.ading and unlo.ading o.f merchandise, freight, o.r
passengers;

(k) At any o.ther place where o.fficial signs pro.hibit ~to.Pping, standing, o.r parking.
(18) Sectio.n'1204(2). Mo.del Traffic Co.de Sectio.n 1204(2)(a) is hereby repealed and
reenacted to. read as fo.llo.ws: '
(a) Within five feet o.f a public o.r private driveway o.r alleyway;
(19) Sectio.n 1205. Mo.del Traffic Co.de Sectio.n 1205(5) is hereby repealed and
reenacted to. read as fo.llo.ws:

(5) Parking no.t to. o.bstruct traffic o.r maintenance. No. perso.n shall park any vehicle
UPo.n a street o.rhighway in such a manner o.r under such co.nditio.ns as to. int~rfere
with the free mo.vement o.f vehicular traffic o.r pro.per street o.f. highway maintenance
o.r to. leave any vehicle parked at the same place o.r substantially the same place fo.r
a perio.d o.f seventy-two. (72) ho.urs.

(20) Sectio.n 1218. The Mo.del Traffic Co.de is hereby amended by the additio.n o.f
Sectio.n 1218, which shall read ~s fo.llo.ws:
Fraudulent use o.f parking reso.urces. No. perso.n shall park a vehicle UPo.n a street o.r
in an alley o.f the City o.f Aspen using actio.n o.r actio.ns intended to. circumvent the'
enfo.rcement o.f the 1995 editio.n o.f the "Mo.del Traffic Co.de fo.r Co.Io.rado. Municipalities"
as amended by o.rdinances o.f the City o.f Aspen.
Sectio.n 3.
This o.rdinartce shall no.t have any effect o.n existing litigatio.n and shall no.t' o.perate
as an abatement o.f any actio.n o.r proceeding no.w pending under o.r by virtue o.fthe
o.rdinances repealed o.r amended as herein pto.vided, and the same shall be co.nstrued
and co.ncluded under such prior o.rdinances.

Sectio.n 4.
If any sectio.n, subsectio.n, sentence, clause, phrase o.r Po.rtio.n o.f this, o.rdinance is
fo.r any reaso.n held invalid o.r unco.nstitutio.nal in a Co.Urt o.f co.mpetent jurisdictio.n,
such Po.rtio.n shall be deemed a separate, distinct and independent provisio.n and shall
no.t affect the validity o.f the remaining Po.rtio.ns thereo.f.
