ORDINANCE No.3.b (Series of 1996) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COJ...ORADO, AMENDING CHAPTERS 25.04 AND 25.16 OF THE ASPEN MUNICIPAL GOnE TO ESTABLISH LATE PAYMENT CHARGES FOR PAST DUE ELECTRIC M\O WATER UTILITY BILLS. WHEREAS, the City Council desires to adopt late payment charges for pas, 'lue electric and water bills to recover the cost of collecting such overdue utility bills. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIIL CITY OF ASPEN, COLORADO: Section 1. That Section 25.04.040(a) of the Municipal Code of the City of Aspen, Colora( , is hereby amended to add a new paragraph (ill) to read as follows: (iii) Payments for electric service charges shall be due twenty (20) days at! the billed date. Any amount due, but not received by the City on or before the next billing date, shall be subject to a past due charge of one and one half percent (1 1/2 %) of the total amount due; subject, however, to a minimum charge of three dollars ($3.00). Balance~: (If less than $5.00 shall not be subject to this charge. Section 2. That Section 25.16 of the Municipal Code of the City of Aspen, Colorado, is hereby amended to add a new section 25.16.022, which section shall read as follows: 25.16.022. Late payment charge. Payments for water service charges shall be due twenty (20) days atter the bille,: date. Any amount due, but not received by the City on or before the next billing date, shal! be subject to a past due charge of one and one half percent (1 1/2%) of the total amount due; ~ubject, however, to a minimum charge of three dollars ($3.00). Balances of less thajJ $5.00 shall not be subject to this charge. ~ e - '41 Section 3. The City Clerk shall provide notice to customers as provided in Section 25.04.040(b) of the Municipal Code. Section 4. That if any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 5. That this ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances amended as herein provided, and the same shall be construed and concluded under such prior ordinances. A public hearing on the ordinance shall be held on the I-S- day of 62 ' ~/, 1996, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
