Mayor Bennett called the meeting to order at 4:40 p.m. with
Councilmembers Waggaman, Paulson, Richards and Reno present.
RESOLUTION #73, SERIES OF 1993 - Contract Golf Course ???
Bill Efting, assistant city manager, told Council this is the
contract for installation of the irrigation recently purchased out
of the asset management plan.
Councilwoman Richards moved to approve Resolution #73, Series of
1993; seconded by Councilwoman Waggaman. All in favor, motion
carried.
LIQUOR LICENSE AUTHORITY - Downtown Sports Center
Sandy Stuller, special counsel, said the city has been offered a
proposed disposition of the charges against the Downtown Sports
Center. The Liquor License Authority has set a hearing for October
22 at 8:30 a.m. for 3 violations of the state liquor code. The
letter from the attorney for the Downtown Sports Center offered to
agree to stipulate to findings of those violations and yto agree to
a suspension of the liquor license. Ms. Stuller said she would
like to hear from the Authority whether or not they are interested
in accewpting this disposition in lieu of the suspension and
revocation hearing. Ms. Stuller suggested if a suspension is
agreed to it be for two months. If the Authority is not confort-
able, they may go on to the hearing. Ms. Stuller said if the
Authority agrees to this, she will draft a resolution.
Reno said he would like to go forward with the hearing in order to
get more information. Ms. Stuller said this is comparable to a
plea bargain and the licensees are willing to stipulate to findings
of violation and to a suspension. The length of the suspension is
up to the authority. Reno said being closed during the off season
may not be a punishment.
Ms. Waggaman said she does not want this Authority to get a
reputation for being soft on drugs. Ms. Waggaman said whoever owns
a liquor license is responsible for what goes on in the premises
Ms. Waggaman said she would not like the penalty to be so severe
that the business is ruined. Paulson said he would like the input
of a hearing before making a decision. Chairman Bennett said 2
months would be a satisfactory sentence. Stipulating to the
changes would save a lot of staff and the Authority's time and
energy.
Ms. Stuller said as part of this action, the licensees will invite
more police walk through the premise; they have hired a doorman to
check ids and do walk throughs of the premises; the lighting has

been changed in the stairway to make this better illuminated. Ms.
Stuller said the licensees are agreeing the city can enter findings
that the violations did occur as written. This will be in the
licensee's record and reported to the state.
John Worcester, assistant city attorney, pointed out being closed
for 2 months is 1/6 of the licensee's income. This establishment
is less tourist oriented than others. Ms. Richards suggested
training or community service for the owners of the establishment.
The Authority decided to offer a settlement; the Downtown Sports
Center will close for 60 days, starting October 15, the entire
staff top take the alcohol awareness traing, and 50 hours of
community service for each owner
