Mayor Bennett called the meeting to order at 4:15 p.m. with
Councilmembers Paulson, Waggaman, Reno and Richards present.
ORDINANCE #35, SERIES OF 1994 - Temporary Overlay Zone District
Mayor Bennett said he had focused on the west end because that is
where most of the 6,000 lots are located. Mayor Bennett said the
problem is not confined to the R-6 zone nor to the west end. Mayor
Bennett suggested as a temporary measure for 6 months to pass the
guidelines for lots of 9,000 square feet or less. A person can
build up to 80 percent of their FAR by right. If a person wants to
maximize their square footage, they have to go through design
review process during this interim period.
Councilman Reno said it is not the size of the houses; it is the
quality of the design. Mayor Bennett reiterated this process does
not limit the size but will have a review process to work on scale,
how to break up the mass. Mayor Bennett said his proposal is a
temporary compromise. Councilman Reno said this is judging size
based on architectural features. Councilwoman Richards said it is
more important that the concerns are taken into consideration for
the final ordinance. Councilwoman Richards said she feels this is
a reasonable interim measure.
Councilwoman Waggaman said she does not want to see this process
die and is willing to accept the 85 percent compromise with the
amendments to the ordinance for scale and mass. Councilwoman
Waggaman said this interim measure will give the city an opportuni-
ty to use the guidelines and to learn from them. Councilwoman
Waggaman said she feels small remodels ought to be exempt.
Mayor Bennett moved to adopt Ordinance #35, Series of 1994, with
the amendments of 85 percent of the FAR, guidelines apply to scale
and mass; mandatory review for lots everywhere in the city 9,000
square feet and less and voluntary compliance for the rest; and
small remodels are exempt; seconded by Councilwoman Richards.
Councilman Reno said he does not know what 85 percent and 9,000
square feet means to individual property owners. Councilwoman
Richards said this would require an interim review on any develop-
ment planned over 85 percent of the allowable FAR. Mayor Bennett
said this would be mandatory for lots 9,000 square feet and less
whatever zone district, review and compliance, and voluntary
compliance for lots larger than 9,000 square feet. Mayor Bennett
suggested the planning staff come up with a review plan to make
sure architects, particularly those from out of town, go through an
educational process. This is for residential, not commercial.
Roll call vote; Councilmembers Paulson, yes; Waggaman, yes;

Councilwoman Richards moved to adjourn at 5:15 p.m.; seconded by
Councilman Paulson. All in favor, motion carried.
