HomeMy WebLinkAboutminutes.council.19960325Aspen City Council Regular Meeting March 25, 1996 Mayor Bennett called the meeting to order at 5:05 p.m. with Councilmembers Marolt, Paulson, Richards and Waggaman present. PROCLAMATION Mayor Bennett read a proclamation declaring March 25 to April 2 as Sunshine Kids National Winter Games Week. CITIZEN COMMENTS There were none. COUNCILMEMBER COMMENTS 1. Councilman Marolt told Council he is quite comfortable on Council and there are several projects he would like to see through to the end. Councilman Marolt said if he is elected County Commissioner through the recall process, he will stay on Council until he can see those projects through. 2. Councilwoman Richards announced there is a fund raiser at Club Soda on Wednesday, March 27, which is inexpensive and benefits several local non-profit groups. 3. City Manager Margerum requested Council remove the executive session, move Ordinance #11 to the consent calendar and to continue Ordinance #10, 616 W. Main Historic Designation. Councilwoman Waggaman moved to continue Ordinance #10, 1996, 616 W. Main Historic Designation; move Ordinance #11, 1996, Bleeker Street Victorians AH/PUD to consent and to delete the executive session; seconded by Councilwoman Richards. All in favor, motion carried. 4. City Manager Margerum circulated a draft letter to Colorado Outdoors supporting a grant request from RMI for them to purchase their Windstar property. Council agreed on submitting the letter. 5. City Manager Margerum said staff is planning an open house May 17 to show off the renovated city hall. This will be in conjunction with National Preservation Week as well as honoring the city volunteers on boards and commissions. City 1 Aspen City Council Regular Meeting March 25, 1996 Manager Margerum said the county is planning a ceremony to open the Maroon Creek Bridge June 1; this will coincide with National Trail weeks. Councilwoman Richards requested staff talk to the county about having a sign on the Maroon Creek bridge requesting people walk their bicycles. Mayor Bennett said he has received suggestions that the bridge be covered, top only. This would make maintenance easier. 6. City Manager Margerum reminded Council the downtown pedestrian group will have their kick off meeting March 30 beginning at 1 p.m. There will be a slide show and walk around town looking at Aspen’s public spaces. CONSENT CALENDAR Councilwoman Richards moved to read Ordinance #11, Series of 1996; seconded by Councilman Paulson. All in favor, motion carried. ORDINANCE #11 (Series of 1996) AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING REZONING FROM R-6 (MEDIUM DENSITY RESIDENTIAL TO AH1/PUD (AFFORDABLE HOUSING/PLANNED UNIT DEVELOPMENT (PUD) APPROVAL FOR THE BLEEKER STREET VICTORIANS PROJECT FOR TWO FREE MARKET UNITS, TWO RESIDENT OCCUPIED UNITS, AND THREE DEED RESTRICTED UNITS SITUATED ON LOTS 1 AND B, BLOCK 66, CITY AND TOWNSITE OF ASPEN, PITKIN COUNTY, COLORADO was read by the city clerk Councilwoman Richards moved to adopt the consent calendar as amended; seconded by Councilman Marolt. Motion carried. 2 Aspen City Council Regular Meeting March 25, 1996 ORDINANCE #8, SERIES OF 1996 - Trueman SPA Amendment Mary Lackner, community development department, told Council there have been changes in the ordinance since first reading based on staff review of the original approval in 1976. Ms. Lackner reminded Council the applicant is seeking to add 17 new uses to the SPA for the Trueman Center. The changes to the ordinance have to do with the amount of SCI space to be part of the building and a requirement to file deed restrictions on the 17 employees units. The service retail uses agreed to by the applicant 20 years ago should total 10,000 square feet rather than the 1500 square feet pointed out at the last meeting. Phil Bloemsma, representing the applicant, told Council this process was started a year ago; the applicant merely wanted to update the uses at the Trueman Center. Bloemsma said that has taken a long time, cost a lot of money, and staff keeps asking for more concessions. Bloemsma said he would like to forget the whole thing. Mayor Bennett said most of elements the city has asked for were requirements of the original approval. The owner of the property has a responsibility to live up to these agreements. John Worcester, city attorney, agreed most of the conditions in the ordinance are conditions of approval from the prior approval. Council requested the ordinance be rewritten to list all the conditional and permitted uses for the Trueman SPA. Councilwoman Richards moved to table Ordinance #8, Series of 1996, to April 8; seconded by Councilman Paulson. Mayor Bennett requested staff prepare the pros and cons on the deed restriction issue. Stan Clauson, community development director, told Council after the P & Z hearing when they did not recommend the application go forward with the exception of 1 additional use, staff recognized it was important to make a succinct record of the prior approved uses and conditions. Clauson told Council staff feels it is not appropriate to charge the applicant for this extra time. Worcester told Council the staff required the deed restrictions to make sure that the units offered at the time of subdivision approval will remain affordable housing and will be deed restricted forever and to also give the housing authority a way to track affordable units. 3 Aspen City Council Regular Meeting March 25, 1996 Councilman Paulson said his problem with SCI/NC is how to handle monster stores versus little shops that are selling the same things. Mayor Bennett suggested a summary from staff of the existing size requirements in NC and SCI zones. Councilwoman Richards said now that the previous commitments have surfaced, she wants to see them met and completed. Mayor Bennett said there will be a public hearing at the next meeting on this item. All in favor, motion carried. ORDINANCE #5, SERIES OF 1996 - Inventory of Historic Sites and Structures, Round III Amy Amidon, community development department, told Council this ordinance was tabled to make sure of the location of the historic resources on the Meadows property. There is a new map attached to the ordinance which the applicant has reviewed and has agreed with the representations. Mayor Bennett opened the public hearing. There were no comments. Mayor Bennett closed the public hearing. Councilwoman Richards moved to adopt Ordinance #5, Series of 1996, on second reading; seconded by Councilman Paulson. Roll call vote; Councilmembers Marolt, yes; Waggaman, yes; Richards, yes; Paulson, yes; Mayor Bennett, yes. Motion carried. ORDINANCE #9, SERIES OF 1996 - Increase Compensation for Council John Worcester, city attorney, told Council this ordinance proposes to raise Council and Mayor’s salaries; Council’s from $800 to $1350 and the Mayor’s $1150 to $1750. This increase takes in the cpi over the years since the last increase. The increase also attempts to provide compensation for councilmembers to buy into the city’s health insurance. Worcester noted the City Charter does not allow a sitting Council to raise their own salaries; this will not go into affect until June 1997 and then only for the newly elected Council. Worcester said this increase is also to recognize the additional work of Council over the last 5 years. Mayor Bennett said he would like to see the two salaries increase the same proportionally. Councilman Marolt said he does not disagree the Council works 4 Aspen City Council Regular Meeting March 25, 1996 hard; however, he questions whether the Council should have to work that hard. The city has a professional staff and management and the onus of that work load should be on staff. Councilman Marolt said he feels there would be a better mix of Council if they were not paid at all. Councilman Paulson said he feels strongly that people should not have to suffer materially in order to serve on Council. Councilman Paulson said he wants employees and workers to be able to serve on Council. Councilman Paulson said he feels it is fair for people to be compensated for the work they are doing. Councilwoman Richards said elected officials should not just react to what staff proposes but should be trying to make projects happen, like the yellow brick school, the Moore playing fields. Councilwoman Richards pointed out Council’s work load is not just limited to the Council table but to other boards, community events, speeches, etc. Councilwoman Richards agreed there is a very capable staff but they need direction from Council as the policy makers. Councilwoman Richards said it is important for the electorate to understand the seriousness of the position. The Council is directing a city with a $30 million budget. Councilwoman Richards said it is important that people who run for office have an expectation of the amount of work that goes with the job. Councilwoman Waggaman agreed there is a lot of involvement other than just Council meetings, preparation and work sessions, and the community demands this involvement. Community and non-profit boards want to have a liaison with Council. Councilwoman Richards pointed out there is a lot of travel commitment with Council, COG, CAST. Mayor Bennett opened the public hearing. There were no comments. Mayor Bennett closed the public hearing. Councilwoman Waggaman moved to adopt Ordinance #9, Series of 1996, on second reading with the amendment that the Council salary be $1200/month and the Mayor salary be $1725/month; seconded by Councilman Paulson. Roll call vote; Councilmembers Waggaman, yes; Richards, yes; Marolt, no; Paulson, yes; Mayor Bennett, yes. Motion carried.
