Application for Land Use Review Dear Al, I've been meaning to contact you for several weeks regarding the. September 1993 application for annexation, rezoning, and SPA review which is still being held in the Planning Office. The last file notation for this case was in early 1994 regarding processing fees. I have not received .any new information regarding this project. Because of the length of time which has elapsed and the number of plan changes which were occurring after it was submitted . .to. us, I .intend to direct the Planning administration. staff to close the file and doa final billing for the project. If there is continued interest in pursuing this application by A.C.E.S., work needs to resume within the next month. Please contact me by May 10 if this is the case. You would then need to meet with a Planner and go over.the current status of the project. If the case is to be closed, Planning would keep one copy of text and. drawings in the retired file. If you would wis4 tp retrieve the extra copies (and rendered presentation board), please do so no later than May 10. I told him we would know more after we get further direction on our water department housing project. Preceding message: From Kim Johnson: the file is listed as a rezoning, conceptual SPA, conditional use, special review, and GMQS Exemption. But of course, it is all dependent upon annexation. What we have on file is so old, I don't think that anything within it could be used for a current review. It was submitted in sept. 1993. You may recall they wanted to swap land with the City, which this plan indicates. After a certain reasonable time, I think it is best to have them reapply. OK? Preceding message: From Rob Umbreit: They said to waive the fees, I think it was believed at the time that they had already paid them, but it was definite that it was a fee waiver. It isn't a lot of money to worry about for Amend 1 I don't think, so if you want I can pay them the whole amount and you can bill them for the additional fees. From Debbie DuBord: I guess what is not clear to me is the action CC took. Did they waive fees or did they say that they would give ACES a non-profits grant that happened to include the cost of the fees? It doesn't matter to city in general, but matters to our dept. budget. The Planning fee deposit that I quoted him for Conceptual SUbdivision/SPA review was $2,669.00, plus $55.00 and $234.00 for Housing and Engineering referrals, respectively. I stressed that due to the specifics issues of this project (ie the "soft housing" concept), it was likely that additional staff hours, meetings, and therefore fee billings would be necessary. This fee information is only specific to the land use reviews required upon annexation. I understand from Jed that annexation itself is not assessed a fee by the city. We have determined that this application is incomplete and cannot yet be considered for scheduling. Please address the following items in order to complete the application. 1. Submit 12 more copies of the blueprints to replace those used for the HPC review. The rezoning map must show the surrounding zone districts in the City and the County, and the current zoning of the subject properties. 2. Detailed responses must be submitted for all review criteria for Conceptual SPA (including proposed dimensional requirements), Rezoning (map amendment), special Review for parking in the Academic zone district, Conditional Use Review for a dormitory and dining hall facilities in the Academic zone district, and GMQS Exemption for affordable housing. This information is the most essential portion of an application and is not addressed at all in the information that was provided. 3. The concepts and program you have discussed over the past few months with staff must be fully described in your application text. 4. No information was included regarding the intended land swap with the City for the purpose of relocating the dwelling behind the Electric station. Attach all correspondence with the City, legal descriptions, proposed plat, etc. 5. Has a separate vacation application been submitted to the city Engineer for the Puppy smith right-of-way? The letter dated January 19, 1993, from Elizabeth Paepcke authorizing the application specifically references a January 19, 1993, plan by conger Fuller Architects. The blueprints submitted on September 13, 1993, are undated except for a separate cover sheet and do not match the drawing attached to Mrs. Paepcke's letter in many ways. I need an updated letter of authorization from Mrs.. Paepcke, specific to th~ submitted plans. Also, I spoke to Assistant city Attorney John Worces.ter about the portion of land held by the Walter P. paepcke Life Insurance Trust. The authorization to proceed with the application concerning this parcel must. come from whoever is noted on the trust agreement as general or managing partner of the trust. I asked John Worcester if there's a time limit between approval of statutory regs and actual annexation/zoning, an if I recall correctly, the deadline is one year, although he preferred them to do it much sooner. The name of the structure proposed for relocation is the ACES' Professor House. 2. The structure is a two-bedroom, one-bath, single-family residence which has been substantially altered and remodeled, and is now used by the applicant as housing for visiting professors during the summer season, and for staff housing during the remainder of the year. 3. The architect's report, in the form of a letter to the applicant, is attached. 4. The applicant estimates the market value of the property on which the structure lies to be in excess of $400,000. No formal appraisal of the property has been made. 5. The applicant's Development Application, of which this specific submission is a part, proposes the deyelopment of extensive and much- needed faculty housing on this and adjacent properties. The present location of this structure interferes with this proposal. The applicant has proposed to the City of Aspen that the structure be moved approximately 150 feet easterly to property owned by the City of Aspen and the applicant. The City is studying the feasibility of using this structure as housing for the City Electrician and his family. Please see memo, Attachment "B". staff Discussion: A.C.E.S. is; recognized throughout the C011llllunity as a valuable open space/park asset which in itself emboqies t;he city's goals to acquire quality lands of this type. ThePark Dedication Fee was established to provide a funding source for purchase and maintenance of these lands. Planning staff believes that it would. be redundant to charge A.C.E.S. this fee as the property has been deed restricteci for the "stlldy and preservation of birds, wildlife, and the ecology." However, there is concern among staff that A.C.E.S. has not followed through with the r'\ commitment to annex t~eir property as promised during negotiations for the Hallam Lake pipeline which was paid for by the city of Aspen. The Planning Office believes that the annexation should be completed before any fee waivers be granted to A.C.E.S. The Water Department grants tap fee waivers only for the initial connection of 100% deed-restricted housing. Any additional work requires appropriate fee payment. Director Ballenger does not support a refund of the $358.50 assessment. Alternatives: The Council could. elect to not approve this request, keeping both of the fees. This fee has already been paid in order to pull a building permit to start construction. We hope the City can refund this amount. The water tap fee is less clear to me, as we are not adding any water fixtures and we are making an undersized (10' x 12') existing bedroom for two into a single bedroom, then constructing another single bedroom approximately 12' x 12'. The number of water users is not increasing. I hope this fee can be refunded as well. At present, these fees constitute 10% of the project cost so I hope you will be able to refund both the Park Dedication Fee and the Water Tap Fee. I appreciate your attention to this matter.
