RE: A.C.E.S. Application for Land Use Review
Dear Al,
I've been meaning to contact you for several weeks regarding
the. September 1993 application for annexation, rezoning, and SPA
review which is still being held in the Planning Office. The last
file notation for this case was in early 1994 regarding processing
fees. I have not received .any new information regarding this
project. Because of the length of time which has elapsed and the
number of plan changes which were occurring after it was submitted
. .to. us, I .intend to direct the Planning administration. staff to
close the file and doa final billing for the project. If there
is continued interest in pursuing this application by A.C.E.S.,
work needs to resume within the next month. Please contact me by
May 10 if this is the case. You would then need to meet with a
Planner and go over.the current status of the project.
If the case is to be closed, Planning would keep one copy of
text and. drawings in the retired file. If you would wis4 tp
retrieve the extra copies (and rendered presentation board), please
do so no later than May 10. Contact Suzanne Wolff at 920-5093 if
you warit. these copies held for you. . ,
I am retiring from the Planning Office. effect:lve June 2.
Therefore, I would like to close out this file in Mayor pass on
a revitalized project to another Planner. .Please let me know your

I spoke with Al Dietch this morning and told him again that the land
swap was not on the top of the city priority list. I told him we
would know more after we get further direction on our water
department housing project.

special review, and GMQS Exemption. But of course, it is all
dependent upon annexation. What we have on file is so old, I don't
think that anything within it could be used for a current review. It
was submitted in sept. 1993. You may recall they wanted to swap land
with the City, which this plan indicates. After a certain reasonable
time, I think it is best to have them reapply. Do you have any
current input from the ACES folks?

If it was definitely a waiver then we (Planning) should refund out of
the revenue accounts and waive new fees as they occur. OK?

They said to waive the fees, I think it was believed at the time that
they had already paid them, but it was definite that it was a fee
waiver. It isn't a lot of money to worry about for Amend 1 I don't
think, so if you want I can pay them the whole amount and you can
bill them for the additional fees.

I guess what is not clear to me is the action CC took. Did they
waive fees or did they say that they would give ACES a non-profits
grant that happened to include the cost of the fees? It doesn't
matter to city in general, but matters to our dept. budget.

After our discussion a couple of Friday's ago about Planning fees
related to this project, I told Al Deitch that Planning fees would
be charged as per any other project of this type and magnitude.
since then, I have given Al the fee schedule and responsibility
form. The Planning fee deposit that I quoted him for Conceptual
SUbdivision/SPA review was $2,669.00, plus $55.00 and $234.00 for
Housing and Engineering referrals, respectively. I stressed that
due to the specifics issues of this project (ie the "soft housing"
concept), it was likely that additional staff hours, meetings, and
therefore fee billings would be necessary.
This fee information is only specific to the land use reviews
required upon annexation. I understand from Jed that annexation
itself is not assessed a fee by the city.

Attached is our Development Application for our proposed faculty
housing, The applicant's name is Aspen Center for Environmental Studies;

Our proposed development is described in the architectural drawings

review standards. Since the application covers so many types of
development, we are not able to describe in detail the nature of such

Dear Mr. Dietsch,
The Planning Office has completed its preliminary review of the
captioned application. We have determined that this application
is incomplete and cannot yet be considered for scheduling. Please
address the following items in order to complete the application.
1. Submit 12 more copies of the blueprints to replace those used
for the HPC review. The rezoning map must show the
surrounding zone districts in the City and the County, and the
current zoning of the subject properties.
2. Detailed responses must be submitted for all review criteria
for Conceptual SPA (including proposed dimensional
requirements), Rezoning (map amendment), special Review for
parking in the Academic zone district, Conditional Use Review
for a dormitory and dining hall facilities in the Academic
zone district, and GMQS Exemption for affordable housing.
This information is the most essential portion of an
application and is not addressed at all in the information
that was provided.
3. The concepts and program you have discussed over the past few
months with staff must be fully described in your application
text.
4. No information was included regarding the intended land swap
with the City for the purpose of relocating the dwelling
behind the Electric station. Attach all correspondence with
the City, legal descriptions, proposed plat, etc.
5. Has a separate vacation application been submitted to the city
Engineer for the Puppy smith right-of-way? If not, please
contact Chuck Roth, City Engineer, at 920-5080.

6. The letter dated January 19, 1993, from Elizabeth Paepcke
authorizing the application specifically references a January
19, 1993, plan by conger Fuller Architects. The blueprints
submitted on September 13, 1993, are undated except for a
separate cover sheet and do not match the drawing attached to
Mrs. Paepcke's letter in many ways. I need an updated letter
of authorization from Mrs.. Paepcke, specific to th~ submitted
plans. Also, I spoke to Assistant city Attorney John
Worces.ter about the portion of land held by the Walter P.
paepcke Life Insurance Trust. The authorization to proceed
with the application concerning this parcel must. come from
whoever is noted on the trust agreement as general or managing
partner of the trust. Vince Higgins at Pitkin county Title
should be able to determine the correct signator(s).

The ACES Board does not want to finalize annexation/rezoning until
they develop a long-term masterplan concept (designating a zone
district can have an impact on their uses...so they are exploring
options). I asked John Worcester if there's a time limit between
approval of statutory regs and actual annexation/zoning, an if I
recall correctly, the deadline is one year, although he preferred
them to do it much sooner. I haven't heard from Cardamone in
months. I'm not assurred that they are making much progress.

.Aspen Center for Environmental Studies,
a Colorado not-for-profit corporation
CITY OF ASPEN (hereinafter CITY) and
(hereinafter APPLICANT) AGREE AS FOLLOWS:
1. APPLICANT has submitted to CITY an application for rezoning;
conceptual SPA, conditional review, special review, GMQS exemption,
relocation of historic structure, and vacation of street.
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that City of Aspen Ordinance
No. 77 (Series of 1992) establishes a fee structure for PIlInning Office applications
and the payment of all processing fees is a condition precedent to a determination
of application completeness. .
3. APPLICANT and CITY agree that because of the size, nature or
scope of the proposed projept, it is not possible at this time to ascertain the full
extent of the costs involved in processing the application. APPLICANT and
CITY further agree that it is in the interest of the parties to. allow APPLICANT
to make payment of an initial deposit and to thereafter permit additional costs to
be billed to APPLICANT on a monthly basis. APPLICANT agrees he will be
benefited by retaining greater cash liquidity and will make additional payments
upon notification by the CITY when they are necessary as costs are incurred.
CITY agrees it will be benefited through the greater certainty of recovering its full
costs to process APPqCANT'S application,
4. CITY and APPLICANT further agree that it is impracticable for
CITY staff to complete processing or present sufficient information to the
Planning Commission and/or City Council to enable the Planning Commission
and/or City Council to make legally required findings for project approval, unless
current billings are paid in full prior to decision.

SPECIFIC SUBMISSION FOR THE
RELOCATION OF HISTORIC STRUCTURE
September 13, 1993
1. The name of the structure proposed for relocation is the ACES'
Professor House.
2. The structure is a two-bedroom, one-bath, single-family residence
which has been substantially altered and remodeled, and is now used by
the applicant as housing for visiting professors during the summer
season, and for staff housing during the remainder of the year.
3. The architect's report, in the form of a letter to the applicant, is
attached.
4. The applicant estimates the market value of the property on which the
structure lies to be in excess of $400,000. No formal appraisal of the
property has been made.
5. The applicant's Development Application, of which this specific
submission is a part, proposes the deyelopment of extensive and much-
needed faculty housing on this and adjacent properties. The present
location of this structure interferes with this proposal. The applicant
has proposed to the City of Aspen that the structure be moved
approximately 150 feet easterly to property owned by the City of
Aspen and the applicant. The City is studying the feasibility of using
this structure as housing for the City Electrician and his family. If the
City determines it is not feasible to use this structure for this purpose,
the applicant will then propose that the structure be demolished.

We h,ave observed the condition of the existing Professor's House as ACES as it relates to relocating. the
residence to the south 01 the Electrical Switching Station and 'have gotten some preliminary estimates'
for the relocal:ion. These estimates are very conceptual and should be reconfirmed or bid in the event
, that YOu decide to move the residence.
The current condition of the Slr.ucture is marginal to bad. The back bedroom addition would have to be
. removed and I'ebullt if desired and you shouid expect some damage to.the materials and linishes inside
which would require repair and/or replacement. The interior allowance is variable depending on the.
extent of interior upgrades are desired, .
The attached ccmttactor 's proposal il for the reJocalioI) of the house, A 20% contingency is inculdedto
cover unknown items and is a reasonable amount for budgeting purposes.

refund of the $358.50 Water Tap Fee. planning staff recommends
that this Park Dedication fee b~ refunded .to .A.C.E.S. upon
annexation of the A.C.E.S. property into the city. The Water

Council Goals: In an ef~?rt for the city to be fair and sensitive
to residents, staff's recommendations support Goal #15. .
Backqround: For residential uses, Park Dedication Fee assessments
are based on numbersqf beqr:qqI\ls~Theprimary A.C.E.S. caretaker
unit (which is located within city Limits) has received a building
permit for the addition of one bedroom.
The intent of the Park Dedtc:atiq!lFee .is t?~u!ldacquisition and
development of parks/recreation. lal1ds~ .. A~<::~:E~S; Director.Tom
Cardamone is requesting that this fee .be refunded'lIi.sFequest
letter states that "Since the property is deed. restricted to
conservation and education purposes, it seems inappropriate for the
City to collect a $780.00 Park Dedication fee." (Attachment "A")
The Water Tap Fee is assessed for "any additional construction or
water fixture additions" according to Director of Water, Larry
Ballenger. Please see memo, Attachment "B".
staff Discussion: A.C.E.S. is; recognized throughout the C011llllunity
as a valuable open space/park asset which in itself emboqies t;he
city's goals to acquire quality lands of this type. ThePark
Dedication Fee was established to provide a funding source for
purchase and maintenance of these lands. Planning staff believes
that it would. be redundant to charge A.C.E.S. this fee as the
property has been deed restricteci for the "stlldy and preservation
of birds, wildlife, and the ecology." However, there is concern
among staff that A.C.E.S. has not followed through with the
r'\
commitment to annex t~eir property as promised during negotiations
for the Hallam Lake pipeline which was paid for by the city of
Aspen. The Planning Office believes that the annexation should be
completed before any fee waivers be granted to A.C.E.S.
The Water Department grants tap fee waivers only for the initial
connection of 100% deed-restricted housing. Any additional work
requires appropriate fee payment. Director Ballenger does not
support a refund of the $358.50 assessment.
Alternatives: The Council could. elect to not approve this request,
keeping both of the fees. Council cOllld. cho()lS~ to. r~fllI1d. ei.ther
or bqth of the fees now, without the contingency of annexation.
Financial Implications: This request would lessen the appropriate
funds by the requested amount unless Council's contingency fund
replaced the monies.
Recommendation: Planning recommends refunding the $780.00 Park
Dedication Fee contingent upon the annexation of A.C.E.S. into the
city. The Water Department does not recommend refund of the
$358.50 water tap fee. If one or both fees. ar~refund~d, Planning
recommends that the City Council contingency fund replace the
monies into the appropriate fund(s).
proposed Motion: I move to approve the refund of the $780.00 Park
Dedication Fee paid by A.C.E.S. at the time that the annexation ();
A.C.E.S. in complete. I also move that the city Council
contingency fund replaces $780 to the Park Dedication Fund when
A.C.E.S. receives its repayment.
I move to deny refund of the $358.50 water tap fee.

Dear Council,
ACES is adding a 190 square foot bedroom addition to its principal
caretaker unit at 100 1/2 Puppy Smith Street. Since the property is deed
restricted to conservation and education purposes, it seems inappropriate
for the City to collect a $780 Park Dedication fee. This fee has already
been paid in order to pull a building permit to start construction. We hope
the City can refund this amount. The water tap fee is less clear to me, as
we are not adding any water fixtures and we are making an undersized
(10' x 12') existing bedroom for two into a single bedroom, then
constructing another single bedroom approximately 12' x 12'. The number
of water users is not increasing. I hope this fee can be refunded as well.
At present, these fees constitute 10% of the project cost so I hope
you will be able to refund both the Park Dedication Fee and the Water Tap
Fee.

The Water Department has to follow the criteria established in the City Ordinances pursuant to
tap fee waivers and ECU assessments,
Tap fees are waived for 100% deed-restricted housing for the initial connection assessment. Any
additional construction or water fIXture additions require the appropriate tap fee payment.
The Water Department cannot grant "relief" from water tap fees. They are established by City
Ordinance.
