RESOLUTION NO. J ~
(Series of 1993)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO NEGOTIATE,
FINALIZE AND EXECUTE DOCUMENTS PERTINENT TO THE SALE OF A PORTION
OF THAT PROPERTY COMMONLY KNOWN AS PIONEER PARK.
WHEREAS, the Aspen Historic Trust and the City of Aspen have
negotiated the purchase of a portion of that property within the
city commonly known as pioneer Park for dedication and use as a
municipal passive park; and
WHEREAS, the purchase of the subject property will assist in
the resolution of pending litigation arising over the potential
uses of the property and its alleged designation as an historic
site; and
WHEREAS, the City Council has determined that it would be in
the public interest to accept ownership and maintenance responsi-
bility for the' property as a municipal park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, that the City Manager and city Attorney
are hereby authorized to negotiate, finalize and execute such
agreements and documents as are necessary to vest title in the
City of Aspen of that portion of pioneer Park to be dedicated as
a municipal passive park and to secure private funding for
capital improvements and the ongoing maintenance for such park.
