HomeMy WebLinkAboutordinance.council.020-92 OHDIN CB # Series of 1992 AN ORDINANCE AMENDING ORDINANCE #60t SERIES OF 1990, BY REPEALING SECTION 5 AND THEREBY ELIMINATING THE EVALUATION PROVISION OF THE COTTAGE INFILL LEGISLATION. WHEREAS, the City Council of the City of Aspen wishes to continue the "Cottage Infill" program as developed in 1990; and WHEREAS, the "Cottage Infill" program provides an innovative choice within the affordable housing program for the Aspen community, and is supported by citizen committees developing the revised Aspen Area community Plan; and WHEREAS, participation within the initial two years of the "Cottage Infill" program indicates community support to continue the program as it currently exists; and WHEREAS, the City Council supports staff's effort to continue to develop additional incentives for the "Cottage Infill" Program. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section Five (5) of Ordinance 60, Series of ].990, providling that said Ordinance shall be evaluated as to its effectiveness on or prior to April 15, 1992, be and is hereby repealed. Section 2 That if any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalidl or unconstitutional by any court of competent jurisdiction, Such shall be deemed distinct and independent portion a separate, provision and such holding shall not affect the validity of the remaining portions thereof° Section 3 That a public hearing on the Ordinance shall be held on the lSth day of April, 1992, at 5:00 p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado, fifteen (15) days prior to which hearing notice of the same shall be published once in a newspaper of general circulation within the city of Aspen.
