HomeMy WebLinkAboutordinance.council.053-92 ,.'.....'.'..... \'i, ~\ '''C, e'. 1\.1..... \1 ,d_,/ , " ORDINANCE NO. 53 Series of 1992 AN ORDINANCE AMENDING SECTION 23-107 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, TO INCREASE THE CHARGE FOR CONNECTING OR DISCONNECTING WATER SERVICES FROM TWENTY FIVE DOLLARS TO THIRTY DOLLARS, AND ADDING A NEW SECTION 23-26 TO ESTABLISH A CHARGE OF THIRTY DOLLARS FOR CONNECTING OR DISCONNECTING ELECTRIC SERVICE. WHEREAS, the City of Aspen Water Department has charged the sum of twenty-five dollars ($25.00) for the connection and disconnection of water service since 1975; and WHEREAS, the City Council wishes to increase the service charge from twenty five dollars ($25.00) to thirty dollars ($30.00) to more accurately collect the actual costs for the provision of such services by City of Aspen Water Department employees; and, WHEREAS, the Municipal Code of the City of Aspen does not establish a service charge for connecting and disconnecting electric service; and, WHEREAS, the City Council desires to authorize the collection of appropriate fees by the City of Aspen Electric Department to partially offset the cost of such services performed by City of Aspen Electric Department personnel. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 23-107 of the Municipal Code of the City of Aspen, Colorado, which section establishes a charge for connecting or disconnecting water services, is hereby amended to read as follows: .......'.'.:.':.... 111 '!;'\ 'It fA "s '" ,ita \1" Sec. 2.3-107. Water service connect and disconnect charge. A service charge of thirty dollars ($30.00) is hereby established for each connection or disconnection of water service howsoever occurring. Section 2 That the Municipal Code of the City of Aspen, Colorado, is hereby amended by adding a new Section 23-26 which section reads as follows: Sec. 23-26. Electric service connect and disconnect charge. A service charge of thirty dollars ($30.00) is hereby established for each connection or disconnection of electric service howsoever occurring. Section 3 This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances amended as herein provided, and the same shall be construed and concluded under such prior ordinances. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a seperate, distinct and independent provision and shall not affect the validity of the remaining portions hereof.
