AN ORDINANCE AMENDING SECTION 20-22 OF THE ASPEN MUNICIPAL CODE BY
THE ADDITION OF A NEW SECTION (e) PROVIDING SAFETY MEASURES TO BE
TAKEN PRIOR TO THE CONDOMINIUMIZATION OF ANY STRUCTURE
WHEREAS, the Aspen City Council desires to amend Section 20-
22 of the Aspen Municipal Code by the addition of a new section
(e) which'~requires that prior to the condominiumization of any
structure, the building inspector shall perform an inspection of
the structure in order to determine whether there exist any life,
health or safety violations which should be corrected by the
applicant,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 20-22 of the Aspen Municipal Code is hereby
amended by the addition of a new section (e) to read as follows;
(e) The applicant must agree to undergo an inspection of the
building or buildings by the BUilding Department prior
to review of the request for condominiumization by the
Planning and Zoning Commission. This inspection shall
primarily concern itself with fire, health and safety
conditions-- the intention is not necessarily to bring
old structures to full compliance with new construction
codes.
Section 2
I~ any subsection, sentence, clause, phrase or portion of
this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be
deemed a separate~ distinct and independent provision and such
holding shall not affect the validity of the remaining portions
thereof.
