AN ORDINANCE RATIFYING A CONTRACT BETWEEN THE CIT~ OF ASPEN AND
REA, CASSENS AND ASSOCIATES, INC. PROVIDING FOR THE PROFESSIONAL
ENGINEERING SERVICES FOR WATER CONSTRUCTION PROJECTS AND
APPROPRIATING THE AMOUNT OF ONE HUNDRED FIFTY THOUSAND DOLLARS
($150,000.00) FROM PRIOR YEAR SURPLUSES OF THE CITY OF ASPEN WATER
FUND, ALL AS MORE SPECIFICALLY PROVIDED HEREIN
WHEREAS, there has been submitted to the City Council a
contract agreement between the City of Aspen and Rea, Cassens and
Associates v Inc. providing for the professional engineering
services for certain water system construction projects, which
agreement the Council wishes to approve, and
WHEREAS, Section 9.13(b) of the Home Rule Charter of the City
of Aspen, Colorado, authorizes the City to execute such agreements
but requires that each such agreement and the terms thereof be
approved by an ordinance duly enacted by the City,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO.
Section 1
That it does ratify and approve that certain contract
between the City of Aspen and Rea, Cassens and Associates, Inc.
attached hereto as Exhibit "A" and incorporated herein by this
reference, and the Mayor is hereby authorized and directed to
execute said contract on behalf of the City of Aspen.
Section 2
That the amount of One Hundred Fifty Thousand Dollars
($150,000.00) from prior year surplus funds in the City of Aspen
Water Fund is hereby appropriated for the payment of such con-
tract.
Section 3
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent Durisdiction, such portion
shall be deemed a separate, distinct and independent provision and
