AN ORDINANCE MAKING A ~UPPmEMENTA APPROPRIATION IN THE
TRANSPORTATON FUND FROM PRIOR;~yEAR FUND BALANCES' FOR
TRANSFER TO THE TRANSIT FuND IN ~HE AMOUNT O~ $108,230,00;
AND TO APPROPRIATE A TRANSFER TO THE TRANSIT FUND FOR
EXPENDITUR FOR THE BUSWAY FEASIBILITY STUDY IN THE ~OUNT OF
$25,000.00 AND FOR BUS DEBT SERVICE~ IN THE AMOUNT OF $83'230.00
WHEREAS, by virtue of Section 9,12 of the Home Rule Charter,
the City Council may make supplemental appropriations; and
WHEREAS, the City Manager has certified that the City has
recognized sufficient prior year Fund Balance in the Transporta-
tion Fund; and
WHEREAS, the City Council is advised that certain transfers
and expenditures must be recognized and approved;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
Upon the City Manager's certification that there are avail-
able for appropriation prior year Fund Balance in excess of those
requested herein, the City Council hereby makes a supplemental
appropriation of $108,230.00 from unappropriated prior year Fund
Balance in the Transportation Fund arid recognizes a transfer from
the Transportation Fund of $108,230.00 for transportation related
expenditures.
Section 2
The City Council hereby makes a supplemental appropriation of
a transfer into the Transit Fund and recognizes the expenditure of
$25,000.00 for the Busway Feasibility Study and $83,230.00 for bus
purchase debt service.
Section 3
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion

shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 4
That a public hearing be held on this ordinance on the
