RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~- (Series of 1981 AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM MECHANICAL CODE, 1979 EDITION; AMENDING CERTAIN SECTIONS OF SAiD CODE; PROVIDING PENALTIES FOR VIOLATIONS OF SAID CODE; AND REPEALING SECTIONS OF THE MUNICIPAL CODE INCONSISTENT THEREWITH WHEREAS, the City Council desires to adopt for the benefit of the City of Aspen, the 1979 edition of the Uniform Mechanical Code, and to repeal existing mechanical code provisions and ordin- ances in conflict therewith, and implement recom~[ended additions and modifications thereto, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Repeal. Sections 7-245, 7-246, and 7-247 of Chapter 7 of the Munici- pal Code of the City of Aspen, Colorado, and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shal.1 not affect or prevent the prosecution or punishment of any person for any act done or co~nitted in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 2. Adoption of the 1979 Edition of the Uniform Mechanical Code. Section 7-245 of the Municipal Code of the City of Aspen, Colorado, shall be reenacted to read as follows: Sec. 7-245. Adoption of the 1979 edition of the Uniform Mechanical Code. Pursuant to the power and authority conferred by the laws of the State of Colorado and the Charter of the City of Aspen, Colorado; there is hereby adopted by reference the Uniform Mechanical Code, 1979 edition (including Appendices A, B and C thereto), published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California 90601. Three (3) copies of the Uniform Mechanical Code adopted herein are now filed in the office of the Clerk of the City of Aspen, Colorado, and may be inspected during regular business hours. RECORD OF PROCEEDINGS 100 Leaves Mechanical Code zs adopted as if set forth at length, except for Section 203 which is declared to be inapplicable to the City of Aspen and is, therefore, expressly deleted. Section 3. Additions or Modifications. Section 7-246 of the Municipal Code of the City of Aspen, Colorado, shall be reenacted to read as follows: Sec. 7-246. Amendments. The Uniform Mechanical Code, 1979 edition, adopted herein is subject to the following additions or modifications and is amended as follows: (a) Section 803 is hereby amended by deletion of the second paragraph to read as follows; Sec. 803. Vented Decorative Appliances. In addition to the general requirements specified in Sec. 802, every vented decorative appliance shall comply with the requirements specified for heating equipment and heating appliances. (b) Sec. 2213(J) is hereby amended to read as follows; Sec. 2213(J). Barbecue or Fireplace Outlets. Ail gas outlets located in a barbecue shall be con- trOlled by an approved operating valve located not iaore than four (4) feet from such outlets. Gas outlets in a solid fuel burning fireplace are not permitted. Section 4. Penalties· Section 7-247 of the Municipal Code of the City of Aspen~ Colorado, is hereby reenacted to read as follows: Sec. 7-247. Violations and Penalties. (a) It shall be unlawful for any person to erect~ install, alter, repair, relocate, add to~ replace, use or main- tain heating, ventilation, cooling or refrigeration equipment in the City, or cause the same to be done, contrary to or in violation of any of the provisions of this code. Maintenance of equipment which wOuld be un- lawful at the time it was installed and which would be unlawful under this code if installed after ~the effec- tive date of this code~ shall constitute a continuing violation of this code. (b) A violation of any of the provisions of the code shall constitute a misdemeanor, punishable upon conviction by a fine not exceeding Three Hundred Dollars ($300.00), or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. B. & L, C0, . ~ occurs or continues unabated after the time limit set for abatement of the vi°laTiOn. Section 5. Severability. If any subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 6. Certification. The City Clerk shall certify to the passage of this ordinance and make not less than three (3) copies of the 1979 editions of the Uniform Mechanical Code available for inspection by the public during regular business hours. Section 7. Public Hearing. A public hearing on the ordinance shall be held on the ~c~/ , 198i, at 5:00 P.M. in the City day of Council Chambers, Aspen City Hail, Aspen, Colorado.
