RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ ~ {Series of 1981) AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION IN THE WHEELER TRANSFER TAX FUND FROM CURRENT YEAR UNAPPROPRIATED REVENUES IN THE AMOUNT OF $262,708.00 FOR THE WHEELER OPERA HOUSE SCHEMATICS, DESIGN AND DEVELOPMENT IN THE AMOUNT OF $106,708.00, FOR WHEELER OPERA HOUSE CONSTRUCTION DOCUMENTS IN THE AMOUNT OF $135,000.00 AND WHEELER OPERA HOUSE ARCHITECTURAL CONSTRUCTION SERVICES IN THE AMOUNT OF $21,000.00 WHEREAS, by virtue of Section 9.12 of the Home RuLe Charter, the City Council may make supplemental appropriations; and WHEREAS, the City Manager has certified that the City has unappropriated current year revenues in the Wheeler Transfer Tax Fund; and WHEREAS, the City Council is advised that certain revenues and expenditures must be recognized and approved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 Upon the City Manager's certification that there are avail-. able for appropriation in the Wheeler Transfer Tax Fund, current year revenues in excess of those previously appropriated, the City Council hereby makes a supplemental appropriation in the amount of $262,708.00 for the renovation of the Wheeler Opera House to be paid to William Kessler, Architect, in the following amounts: $i06,708.00 for schematics design and development of Wheeler Opera House renovation plans; $135,000.00 for construction documents on such renovation, and $21,000.00 for architectural construction services. Section 2 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent 3urisdiction, such portion shall be deemed a separate, distinct and independent provision and FORI~ ~0 C.F.
