CO, RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 64 (Serie of 1981) AN ORDINANCE RECOGNIZING UNANTICIPATED REVENUES IN THE WHEELER TRANSFER TAX FUND OF $100,000 AND APPROPRIATING FROM CURRENT YEAR UNAPPROPRIATED REVENUES $30,000 AND PRIOR YEAR UNAPPROPRIATED RESERVES OF $140,000 WHEREAS, by virtue of Section 9.12 of the Home Rule Charter, the City Council may make supplemental appropriations; and WHEREAS, the City Manager has certified that the City has unappropriated current year revenues and prior year reserves in the Wheeler Transfer Tax Fund;and WHEREAS, the City Council is advised that certain revenues and expenditures must be recognized and appproved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 Upon the City Manager's certification that there are avail- able for appropriation in the Wheeler Transfer Tax fund, current year revenues and prior year unappropriated reserves in excess of those previously appropriated, the City Council hereby makes a supplemental appropriation in the amount of $170,000 for the Wheeler Opera House construction costs to be incurred this year; and recognizing additional unanticipated revenues of $100,000 in the Wheeler Transfer Tax Fund generated by trans£er tax sales more than was anticipated. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not a£fect Other provisions or application of the ordinance which can be given effect without the invalid provision or applica- tion, and to this end the pr'ovisions of this ordinance are d~eclared to be severable. ~ FORM 50 C.F.
