(Series of 1981)
AN ORDINANCE AMENDING SECTIONS 24-2.1 AND 24-3.2 OF THE MUNICIPAL
CODE OF THE CITY OF ASPEN BY THE CREATION OF A GOLF COURSE SUPPORT
OVERLAY ZONE DISTRICT, AND BY AMENDING THE PERMITTED USES OF THE
PARK ZONE DISTRICT
WHEREAS, the Aspen Land Use Plan constitutes a major revision
and update of the 1966 Aspen Area General Plan and contains, as an
adopted policy, that Aspen should "strengthen the conu~unlty's
economic base in harmony with tourist activities and encourage
diversification of quality recreational and cultural pursuits",
and
WHEREAS, the Aspen City Council desires to promote the imple-
mentation of this policy by encouraging high quality golf course
support facilities which wi±± strengthen the economic base of the
community as a year-round resort, and
WHEREAS, the Aspen City Council finds that there is no zone
district currently within the Aspen Zoning Code which will permit
the development of high quality golf support facilities, and
WHEREAS, Section 24-12.3 of the Aspen Municipal Code provides
that amendments to the zoning code or the zoning district map may
be initiated by City Council or the Planning and Zoning Con~nission
at any time during the year, and
WHEREAS, by Resolution No. 39, Series of 1981~ the Aspen City
Council did initiate an amendment to the Municipal code of the
City of Aspen for the purposes of creating a Golf Course Support
Overlay Zone District, with accompanying permitted uses and area
and bulk requirements, and
WHEREAS, at a public nearing on September 29~ 1981, the Aspen
Planning and Zoning Co~nission did consider the proposal to create
a Golf Course Support Overlay Zone District, with accompanying
permitted uses and area and bulk requirements and did concur with

the City Council resolution regar~in9 th=~ need for the proposed

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO;
Section i
That Section 24-2.1(a) of the Municipai Code of the City of
Aspen entitled "Creation of Districts" be and the same is hereby
amended Dy adding a new subsection (27) for the purpose o~ creat-
ing a new golf course support overlay zone district, to read as
follows:
"(27) Golf Course Support (Overlay)"
Section 2
That Section 24-3.2 of the Municipal Code of the City of
Aspen entitled "Permitted and Conditional Uses" be and the same is
hereby amended by adding the following as permitted uses in the
Park zone district when a Golf Course Support designation appears
on the zoning district map:
(5) When a Golf Course Support (GCS) designation appears on
the zoning district map, all the uses in paragraph (1);
lodge; conference facimity; restaurant and bar; sport
shop; golf and maintenance facilities; active recrea-
tional facilities such as tennis courts and swi~m~ing
poo~s; housing ~or lodge employees; parking lot.
Section 3
If any section, subsection, sentence, c~ause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent 3urisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding sha±i not affect the validity of the
remaining portions thereof.
Section 4
A public hearing on the ordinance shall be held on the ?~

the City Council Chambers, Aspen City Hall, Aspen, CoLorado, i5
days prior to which hearing notice of the same shall be published
once in a newspaper of ,~'enera± circulation within the City of
Aspen.
