AN .ORDINANCE ANNEXING A TRACT OF LAND KNOWN AS THE UTE
CtIILDREN'S PARK LOCATED IN PITKIN COUNTY, COLORADO,
WHICH ANNEXATION IS ACCOMPLISHED PURSUANT TO THE
PROVISIONS OF THE COLORADO MUNICIPAL ANNEXATION ACT OF 1965
WHEREAS, the City COuncil desires to annex to the City of
Aspen a tract of land owned solely by the City of Aspen, known as
the Ute Children's Park, pursuant to the applicable provisions of
the Colorado Municipal Annexation Act; and
WHEREAS, the Colorado Municipal Annexation Act, C.R.S. 1973,
Section 31-12-i06(c), provides that when a municipality is the
sole owner of the area that it desires to annex, the governing
body may by ordinance annex said area to the municipality without
notice and hearing (other than that incident to ordinance adop-
tion), and the City CoUncil now wishes to so proceed; and
WHEREAS, upon annexation of the aforesaid property the City
Council desires to bring the subject parcel under the zoning
ordinances and maps of the City and that the subject parcel be
zoned "P" - Park.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO~
Section 1
It is hereby determined as follows;
1. The parcel described and proposed to be annexed herein
is owned by the City of Aspen, Colorado, and is not solely a pub-
lic street or right-of-way.
2. NOt ±ess than one-sixth (1/6) of the perimeter of the
area to be annexed is contiguous to the City of Aspen.
3. The annexation will not affect the constitution of any
existent school district.

4. The area proposed to be annexed is appropriate for
annexation and within the requirementS of Section 31-12-105,
C.R.S. ±973, and ali other applicable provisions of the COlorado
Municipal Annexation Act.
Section 2
That the fOlloWing described tract, situate in Pitkin County,
Colorado,. be and the same is hereby annexed to the City of Aspen,
Colorado, pursuant to the provisions of the Colorado Municipal
Annexation Act;
A parcel of land lying ill the Southwest one-quarter of Sec-
tion 18, TOwnship 10 South, Range 84 West of the 6th Princi-
pal Meridian, County of Pitkin, State of Colorado, being more
particularly described as follows:
Beginning at Corner No. 9 Riverside Placer No. 3905 AM, also
being Corner No. 10 of Tract "B" (41) Aspen Townsite Addi-
tion; thenCe South 38010' West 158.12 feet; thence North 60°
24' West 125.00 feet~ thence North 03°21' East 65.80 feet to
Corner No. 9, Tract "B" (41) (A 1954 Brass Cap found in
place); thence South 89007' East 202.59 feet to the point of
beginning containing 0.38 acres more or less.
Section 3
In connection with the annexation of the aforesaid parcel the
City Council hereby directs that zoning procedures be initiated to
zone the subject parcel to "P" - Park.
Section 4
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall
not affect the validity of the remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the.~

of general circulation within the City of Aspen.
