RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 75 (Series of 1981) AN ORDINANCE REPEALING AND REENACTING SECTION 4-31 O~ THE ASPEN MUNICIPAL CODE TO RECLASSIFY OPERATORS SELLING AT RETAIL FERMENTED MALT AND ALCOHOLIC LIQUOR AND AMENDING SECTION 4-32 PROVIDING FOR THE INCREASE OF THE ANNUAL OCCUPATIONAL TAX REQUIRED TO BE PAID PRIOR TO THE ISSUANCE OF A LIQUOR LICENSE WHEREAS, the City Council desires to amend Section 4-31 of the Aspen Municipal Code to provide a classification fOr arts liquor license holders, and WHEREAS, the City Council desires to ~nend Section 4-32 of the Aspen Municipal Code to provide that the annual occupational tax required to be paid to the City prior to the issuance of a liquor license be raised, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO; Section That Section 4-31 of the Aspen Municipal Code is hereOy repealed and reenacted to read as follows: "Sec. 4-31. Classification of operators. The business of selling at retail any fermented malt bever- ages and alcoholic liquor, other than medicinal liquors, is hereby defined and separately classified for the purposes of this chapter as follows: Class "A" operators. Ail operators who are licensed to sell alcoholic liquors for consumption on the premises either as hotels or restaurants or taverns shall be class "A" opera- tors. Class "B" operators. Ail operators licensed to sell beer and wine only by the drink for consumption on the premises shall be class "B" operators. Class "C" operators. All operators licensed as retail liquor stores or as drugStores to sell in original containers for consumption off the premises shall be class "C" operators. Class "D" operators. Ail operators licensed to sell alco- holic liquors as arts shall be class "D" operators. FORM SO C. F, HO£CKEL g. B. 8: L. CO. RECORD OF PROCEEDINGS 100 Leaves Class "E" operators. All operators licensed to sell alco- holic liquors as clubs are class "E" operators. Class "F-i" operators. Ali operators licensed to sell fer- mented malt beverages and who sell the same for consumption on the premises are class "F-l" operators. Class "F-2" operators. All operators licensed to sell fer- mented malt Deverages and who sell the same solely in the original package or container for consumption off the pre- mises shall De class "F-2" operators. Class "F-3" operators. All operators licensed to sell fer- mented malt beverages and who sell the same for consumption on the premises and in the original package or container for consumption off premises shall De class "F-3" operators." Section 2 That Section 4-32 of the Aspen Municipal Code is hereby repealed and reenacted to read as follows: "Sec. 4-32. Tax levy and assessment. There is hereby levied and assessed an annual occupation tax upon the business of selling fermented malt beverages and alcoholic liquors, except medicinal liquors, in the city, as such occupation has been classified in section 4-31, as fol- lows; (i) For ail class "A" operators the sum of ..... $750.00 (2) For ail class "B" operators the sum of ..... $500.00 (3) For all class "C" operators the sum of ..... $500.00 (4) For ali class "D" operators the sum of ..... $100.00 (5) For ali class "E" operators the sum of ..... $200.00 (6) For all class "F-i" operators the sum of .... $200.00 (7) For all class "F-2" operators the sum of .... $200.00 (8) For all class "F-3" operators the sum of .... $200.00 For all Class A, B, D and E operators with extended hours permits (8:00 p.m. to midnight on Sundays and Christmas) there will De an additional occupation tax o~ $150.00." Section 3 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutionai by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining por- tions thereof.
