AN ORDINANCE REPEALING AND REENACTING SECTIONS 20-20,
24-3.3(a), 24-8.27 and 24-12.5[b)(5) OF THE ASPEN
MUNICIPAL CODE TO REFLECT THAT LAND USE APPLICATION
FEES SHALL BE ESTABLISHED BY SEPARATE ORDINANCE
WHEREAS, the City of Aspen []as committed itself to revising
on a regular basis, as part of its municipal budget hearing pro-
cedures, the fees which it charges for basic municipal services,
and

WHEREAS, the establis~lment of land use application fees by
separate ordinance will facilitate their regular review and update
in a simple and efficient manner and will avoid repeated amend-
ments to the Municipal Code and, therefore, the City Council
desires to repeal and reenact Sections 20-20, 24-3.3(a), 24-8.27
and 24-12.5(b)(5) of the Municipal Code of the City of Aspen to
reflect that land use application fees shall be established by
separate ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 20-20 of the Municipal Code of the City of Aspen
entitled "Subdivision Fees" be and the same is hereby repealed and
reenacted as follows:
"Sec. 20-20. Subdivision fees.
The fees for processing applications for subdivision, sub-
division exception and subdivision exemption shall be estab-
lished by ordinance of the City Council."

Section 2
That Section 24-3.3(a) of the Municipal Code of the City of
Aspen entitled "Grant of Conditional Use" be and the same is
hereby repealed and reenacted as follows:
"(a) Ail applications for approval of a conditional use shall
be processed pursuant to the provisions of section 2-22
of the Municipal Code of the City of Aspen as if the
request were one for a use variance, provided that the
applicant need not establish the grounds for variance
stated in subsection (d) thereof; and provided that the
fees for the processing of an application for approval
of a conditional use shall be established by' ordinance
of the City Council, rather than as set forth in subsec-
tion 2-22(c) (4) ."
Section 3
That Section 24-8.27 of the Municipal Code of the City of
Aspen entitled "Fees for PUD Processing" be and the same is hereby
repealed and reenacted as follows:
"Sec. 24-8,27. Fees for PUD processing.
The fees for processing a PUD application shall be estab-
lished by ordinance of the City Council."
Section 4
That Section 24-12.5(b)(5) of the Municipal Code of the City
of Aspen entitled "Application by Private Landowners" be and the
same is hereby repealed and reenacted as follows:
"(5) The fees for processing applications by private land-
owners for rezoning shall be established by ordinance of
the City Council."
Section 5
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
