HomeMy WebLinkAboutordinance.council.083-81 PEOPLE'S ORDINANCE NO. ~--~ AN ORDINANCE PROVIDING FOR THE USE OF A SINGLE VOTING PRECINCT AT TO BE HELD ON JANUARY 12, 1982. WHEREAS, the City Council (the "Council") of the City of Aspen, Colorado (the "Council"), in the County of Pitkin and State of Colorado, a municipal corporation duly organized and existing as a home rule municipal corporation pursuant to article XX of t~e~ C0!0rad0~Co~t.itution,~.~ has heretofore determined, by Resolution No. ~ , adopted on ~ /~., 1981, and by Resolution No. ~ , adopted on December 9, 1981, to hold a special municipal election on January 12, 1982, for the purposes set forth in said resolutions; and WHEREAS, the Council has determined, and hereby determines, that the use of a single voting precinct for said special municipal election will maximize the con~nien¢.e~ of the voters. ~R~~[~ NOW, THEREFORE, BE IT ~BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. All action heretofore taken by the Council and officers of the City, not inconsistent with the provisions of this ordinance, toward the special municipal election herein authorized and toward the use of a single voting precinct therefor, be, and the same hereby is, ratified, approved and confirmed. Section 2. Pursuant to Section 2.3 of the City Charter, the Council has heretofore adopted Ordinance No.~-~/ , establishing multiple voting precincts. The Council has deter- mined, and hereby determines, that, solely for purposes of the special municipal election to be held on January 12, 1982, as herein authorized, the City shall constitute one single voting precinct, the boundary of which shall be the same as the boundary of the City. This ordinance shall supersede said Ordinance No. ~-~/, but only as to the January 12, 1982 special municipal election herein authorized. Section 3. The officers of the City be, and they hereby are, authorized and directed to take all action neces- sary or appropriate to effectuate the provisions of this ordinance. Section 4. In any section, paragraph, clause or provision of this ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability -2- of such section, paragraph, clause or provision of trois ordinance. shall not affect any of the remaining provisions of this ordin- ance. Section 5. This ordinance, immediately on its final passage, shall-be n~nbered and recorded in the official records of the City kept for that purpose, authenticated by the signatures of the Mayor and City' Clerk and by the certificate of publication thereof, and shall be published in a legal newspaper of general circulation in the City. The Council hereby determines, pursuant to Section 4.10 of the City Charter, that such publication shall be by publication of the title and a summary of the subject matter hereof together with a statement that copies of the text hereof are available for public inspection and acquisition in the office of the City Clerk. The form for such publication shall be substantially as follows: (Form of Ordinance Summary for Publication after Final Passage) NOTICE IS HEREBY GIVEN that an ordinance entitled: AN ORDINANCE PROVIDING FOR THE USE OF A SINGLE VOTING PRECINCT AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON JANUARY 12, 1982. was adopted on second and final reading on December 28, 1981, by the City Council of the City of Aspen, Colorado. The following is a brief summary of the provisions of the ordinance: The ordinance ratifies prior consistent action by the officers of the City; provides for a single municipal election precinct to be used for the special municipal election to be held on January 12, 1982 only; authorizes City officers to take appropriate action to effectuate the ordinance; provides for severability and for repeal of conflicting enactments; prescribes this form of summary for publication of the ordinance after its final passage; and provides that the ordinance shall be.~effec- tive five days after its publication following final passage. Copies of the ordinance are available for public inspection and acquisition at the office of the City Clerk during normal office hours. /s/ Kathryn S. Mayor -5- It was thereupon moved by Council Member~'~ and seconded by Council Member ~ that the forego~hg~ ordinance be passed on first reading, and that said ordinance be published in full and be set for public hearing and consider- ed for final passage at a regular meeting of the City Council to be held in the City Hall, Aspen, Colorado, on Monday, December 28, 1981, at the hour of 5:00 p.m. The question being upon the adoption of said motion, the roll was called with the following result: Herman Edel Susan Michael Charles Collins Dick Knecht George Parry Yes / No Those absent: ~ ~c~P~ ~ members of the City Council having voted in favor of the motion, the presiding officer thereupon declared the motion carried, and the ordinance passed on first reading and the time for public hearing and consideration of final passage thereof set as aforesaid. The City Council then considered and disposed of other matters unrelated to the special election. There being no further business to come before the City Council, on motion duly made, seconded and unanimously carried, the Council adjourned.
