AN ORDINANCE AMENDING THE DEFINITION OF SUBDIVISION
20-3 OF THE MUNICIPAL CODE TO INCLUDE THE LAND TO BE USED FOR
HOTEL, LODGE, MOTEL AND DORMITORY CONSTRUCTION
ORDINANCE NO.
(Series of 1981)
WHEREAS, it is becoming increasingly apparent that the devei-
opment of a lodge, hotel, motel or dormitory in Aspen is an ex-
tremely complex process, involving such issues as traffic genera-
tion, parking, employee housing, accessory commercial uses and
landscaping; and
WHEREAS, the magnitude of lodge, hotel, motel and dormitory
development in Aspen is such that it is desirable to have a com-
plete review of any such development proposal, including the sub-
misszon of a final plat for consumer protection purposes; and
WHEREAS, the Aspen Plannzng and zoning Co~m~ission has recom-
mended that lodge, hotel, motel and dormitory development be pro-
cessed under the suDd iv is ion review process; and
WHEREAS, the City Council does concur wit~ the Planning and
zoning Conm~ission and desires to amend the defznition of "subdivi-
sion'' as set ~orth in Section 20-3 of the Municipal Code of the
City of Aspen, so as to include land used for hotel, motel, lodge
or dormitory construction.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 20-3(s)(2) of the Municipal Code of the City of
Aspen entitled .'Definitions" be and the same is hereby amended so
as to include hotel, lodge, motel or dormitory development within
the definition of ,'subdivision" as follows:
"(2) A tract of land to be used for condominiums, apartments
or any other multiple-dwelling units, or for time-shar-
lng dwelling units, or for hotel, lodge, motel or dorm-
itory development; or

Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional 'Dy any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such 'holding shall not affect the validity of the remaining pot-
tions thereof.
Section 3
A puDlic hearing on the ordinance shall be held on the _ _
