AN ORDINANCE REZONING THE 'U.S. FOREST SERVICE PROPERTY AT HALLAM
STREET BETWEEN SEVENTH AND EIGHTH STREETS FROM R-6 TO R-6/SPA
WHEREAS, the U.S. Forest Service is the owner of approxi-
mately 135,000 square feet of real property, more specifically
described as follows: Lots A, B, C, D, E, F, G, H, I, J, K, L, M,
N, O, P, Q, R and S, Block 9, City and Townsite of Aspen, and Lots
A, B, C, D, E, F, G, H, I, M, N, O, P, Q, R and S, Block 10, City
and Townsite of A~pen, and
WHEREAS, said real property is currently zoned R-6, permit-
ting the construction of one and two fanlily dwellings, but not
multi-family structures, and
WHEREAS, just prior to the end of the previous fiscal year,
the Aspen Ranger District office of the White River National
Forest Service was granted monies for the purposes of constructing
crew quarters in a multi-family configuration at the rear of their
property, and
WHEREAS, the U.S. Forest Service has indicated its willing-
ness to cooperate, to the maximum extent possible, with zoning and
subdivision regulations of the City of Aspen, and
WHEREAS, the Aspen Planning and zoning Commission did hold a
public hearing to consider sponsoring a rezoning of the site to
R-6/SPA on October 20 and November i7, 1981, and
WHEREAS, the Planning Commission did concur with the Planning
office in recommending to City Council that the site be rezoned to
R-6/SPA so that the Forest Service can suDmit a precise plan for
the area, by which the underlying use requirements may De varied
and by which a total plan for the site can be reviewed and placed
on the public record for future review reference, and

WHEREAS, the Aspen City Council does

NOW, THEREFOR ,
CITY OF ASPEN, COLORADO:
Section 1
That from and after the effective date of this ordinance, the
property owned by the U.S. Forest Service at Haliam Street between

lows: Lots A, B, C, D, E, F, G, H, I, J, K, L, M, N, O, P, Q, R
and S, Block 9, City and Townsite of Aspen, and Lots A, B, C, D,
E, F, G, H, I, M, N, O, P, Q, R and S, Block i0, City and Townsite
of Aspen, shall be zoned R-6/SPA, and be subject to those zoning
regulations applicable to said zone district and described in
Chapter 24 of the Aspen Municipal Code (as now exists or may here-
after be amended.)
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining pot-
tions thereof.

A public hearing on the ordinance shall be held on the

the City council Chambers, Aspen City Hail, Aspen, Colorado, 15
days prior to which hearing notice of the same shall be published
once in a newspaper of general circulation within the City of
Aspen.
