The photo shows that tJ:1e garage is screened from the street. REQUEST SUMMARY: Variance to the Residential Design Standards to convert two, single-stall garage doors into one double garage door. ADDRESS: 808 Bonita Drive (off of Cemetery Lane), Lot 2bWest Aspen Subdivision, Filing 1 (one half of a duplex) Adam Cherry, represented by Jess Ped.ersen, Pedersen Architectural Services, LLC DENIAL OF THE VARIANCE TO THE RESIDENTIAL DESIGN STANDARDS APPLICANT: STAFF RECOMMENDATION: CHERRY RESIDENCE STAFF REpORT PAGE 1 ~~ r---, REQUEST SUMMARY: The applicant currently has a two-car garage with individual, single-stall garage doors. With this variance request, the applicant proposes to replace the single-stall doors with one, double stall garage door (See Exhibit B for photo comparison provided by the applicant). According to the applicant, the reason for the request is because of the difficulty the owner currently experiences pulling into individual garage doors due to the short turning radius from the driveway. Because there is no alley servicing the lot, the garage in the rear of the lot' is accessed from a driveway from the street along the very edge of the lot, which in turn does not allow for it convenient area for sharp turning movements. According to the applicant, a double stall garage door will facilitate easier access in and out of the garage. As the Residential Design. Standards of the Land Use Code preclude the use of a double stall garage door, the applicant is proposing this variance request. . REVIEW PROCESS: The applicant requests the following land use approval for the proposal described above: Residential Design Standards Variance; According to Section 26.410.020, variances to the Residential Design Standards may be granted by the Design Review Appeal Committee, the Plantling and Zoning Commission or the Historic Preservation Commission; In this case, the staff believes that the Planning and Zoning Commission is best suited to review the variance requests of this nature. Final Review Authority: Planning'and Zoning Commission BACKGROUND/EXISTING CONDITIONS: The West Aspen Subdivision was approved for annexation into the City of Aspen by the City Council in 1970. PREVIOUS ACTIONS: There was a previous duplex on the site that was constructed in 1973-74 and later demolished around 1995. A new duplex was constructed in 1996-97 and then condominiumized in 1997 thus creating separate ownership of each unit. STAFF COMMENTS: RESIDENTIAL DESIGN STANDARDS; According to the Code, any appeal for exemption from the Residential Design Standards must identify why, if granted; the exception would: (1) yield greater compliance with the goals of the Aspen Area Community Plan (AACP), and (2) more effectively address the issue or problem a given standard or provision responds to, or be clearly necessary for reasons of fairness related to unusual site specific constraints. The following is the Residential Design Standard, from which the applicant is requesting variance, and staff response as to compliance with the above criterion: CHERRY RESIDENCE STAFF REpORT PAGE 2 ~ SECTION 26.410.040 C.2. PARKING, GARAGES, AND CARPORTS. For all residential uses thqt do not have access from an alley or private road, the following standards shall be met: f The garage doors shall be single stall doors. STAFF FINDINGS: Based on the strict interpretation of the Land Use Code" s~ffis Ull~91e t91TIcUc.ea gnding that the proposal "yields greater compliance" with the AACP as required in criteria #1 above, because the document is general in ,nature and does not. address a small site- specific issue such as this variance request. Because staff is unable to make this frnqing, a recommendation for denialis prOposea(STarrcroes;nowever~ti'ila"tharfu~t'propos'ar meets criteria #2, See Exhibit A for explanation). However, gjven the following reasons, staff does not have any strong objections to the P&Z approving the variance request, should they choose to do so: , a.) Staff feels that the impact of the double stall garage door is limited to the residents of this site, as there is no view of the door from any street, nor is there any maj or view of the garage from neighboring properties (see photo below); and, b.) The proposed double garage door will be designed to appear like single-stall doors (see building elevations in the Application for design); and, c.) Staff has proposed, and the P&Z has approved, changes to the Residential Design Standards (which are awaiting City Council review) that would allow for a double stall garage door - without a variance - for garages that are not visible from any street; and, d.) The P&Z has approved similar requests in the adjacent neighborhood (Alice Brien 'Residence at 1390 & 1392 Snowbunny Lane & Chef Winchester Residence at 775 & 777 Cemetery Lane) by finding that the proposal does "yield greater compliance to the AACP" (even though staff recommended denial of the variances on similar grounds as in this case). A view from the approximate location of the garage towards the immediate neighbor, While staff usually only considers the view impacts from the street, this photos shows that there is a good landscape buffer between the properties, at least during the smnmer inonths. STAFF SUMMARY AND RECOMMENDATION: Staff recommends denial of the Variance to the Residential Design Standards for Lot 20, West Aspen Subdivision, Filing 1. RECOMMENDED MOTION: "I move to approve (ALL MOTIONS ARE WORDED IN THE AFFIRMATIVE) Resolution No. _, Series of 2003, for a Variance to the Residential Design Standards for Lot 20, West Aspen Subdivision, Filing I." All appeal, for exemption. from the Residential Design Standards should simply and succinctly identify why, if granted, the exception would: (1) yield greater compliance with the goals of the Aspen Area Community Plan, and. STAFF FINDING: DOES IT COMPLY? No The AACP is a general document addressing large community issues. Therefore, staff is unable to find any goal of the AACP that would be applicable in this instance, so is unable to make a finding that the variance yields reater com liance with the document. (2) more effectively address the issue or problem a given standard or provision responds to, or be clearly necessary for reasons Qffairness related to unusual sitespecific constraints. STAFF FINDING: DOES IT COMPLY? YES Staff finds that the exception in this case, would more effectively address the issue the standard responds to because it would allow a garage placed on the rear of the lot to be more efficiently accessed. When the house was designed, it appears that a conscious effort was made to mitigate the impact of the garage to the streetscape by placing it in the rear of the lot, even though the Residential Design Standards only require that garages not accessed by an alley be setback from the front fayade of the house, not be wider than the house, and not be wider than 24' (but, allowing the garage doors to be visible from the street). By placing the garage in the rear ofthel()t,where it is not visible at all from the street, and by allowing the applicant easier access iothe garage via a double stall garage door, staff finds that this design solution addresses the goal of reducing the negative views of gara es more effectively.
