Mayor Klanderud called the meeting to order at 5:00 p.m. with
Councilmembers Paulson, Semrau, Richards and Torre present.
CITIZEN COMMENTS
1. Si Coleman suggested the city sponsor free Intemet access in public
spaces to add to dwell time in the mall. Council directed staff to look into
costs of this.
COUNCILMEMBER COMMENTS
1. Mayor Klanderud noted the death of two city employees. Thomas
"Stogie" Maddalone was employed in the electric department from 1956 to
the mid-eighties. Maddalone was a dedicated employee and the city's
electric building is named after him in recognition for his excellent
continued service to the city. Gregorio Cuevas died while working at the
water department. He, too, was a very dedicated employee. His boss
comments that everyone wanted to have Cuevas on their team. Cuevas
loved life and enjoyed his work.
2. Councilwoman Richards noted that the previous food service at
Truscott appears to have fallen in disrepair. Councilwoman Richards
requested staff look into this, as it is very unattractive.
CONSENT CALENDAR
Councilman Semrau requested Resolution #73, 2004 be pulled. Councilman
Paulson requested Resolution #74, 2004 be pulled.
Councilwoman Richards moved to approve the consent calendar as
amended; seconded by Councilman Torre. The consent calendar is:
· Resolution #72, 2004 - Appointment of Deputy Municipal Judge
· Resolution #75, 2004 - Supplemental EOTC ½% Transit Sales Tax
Budget

RESOLUTION #73, 2004 - ARC Painting Contract
Councilman Semrau noted staffhas said they will try and recover the cost of
this contract $450,000 through the lawsuit. Councilman Semrau asked if the
down time would also be recovered. Ed Sadler, assistant city manager, said
staff feels it will be difficult to recover the down time expenses. Sadler told
Council the lawsuit is scheduled for trial August 2005. Sadler said the
budget for this is $450,000. The scaffold will be up and they hope to paint
and to install the sound baffling with one installation of the scaffold. Sadler
suggested offering $1,000/day incentive to finish early. Councilman Semrau
suggested Sadler approach the contractor to see what he would offer.
Councilman Semrau moved to approve Resolution #73, Series of 2004;
seconded by Councilwoman Richards. All in favor, motion carried.
RESOLUTION #74~ 2004 - Soldner/Buflingame Annexation
John Worcester, city attorney, reminded Council the city, Soldner and
Zolines entered into a 3-way agreement to accommodate the westerly road
alignment. Worcester went over the annexation map, pointing out the
triangular piece the city will convey to the Soldners to be de-annexed in a
different legislation. The Soldners want all of their land outside the city
boundaries. This annexation is for land the Soldners conveyed to the city.
Councilman Paulson said he pulled this off the consent calendar so that he
could vote against the annexation.
Councilwoman Richards moved to approved Resolution #74, Series of 2004;
seconded by Councilman Semrau.
Mayor Klanderud said she, too, is opposed to this project and to the road;
however, this action is only to find compliance with the state statutes.
All in favor, with the exception of Councilman Paulson. Motion carried.

COLORADO, APPROVING THE ANNEXATION OF CERTAIN
TERRITORY TO THE CITY OF ASPEN, COLORADO, TO BE KNOWN
AND DESIGNATED AS THE "WEST HOPKINS ANNEXATION."
ORDINANCE NO. 27

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN
APPROVING AMENDMENTS TO SECTION 26.710.090 OF THE CITY
OF ASPEN LAND USE CODE - RESIDENTIAL MULTI-FAMILY
(RMF) ZONE DISTRICT AND SECTION 26.710.100 OF THE CITY OF
ASPEN LAND USE CODE RESIDENTIAL MULTI-FAMILY A
(RMFA) ZONE DISTRICT.
Councilwoman Richards moved to adopt ordinances #25, 26 and 27, Series
of 2004 on first reading; seconded by Councilman Semrau. Roll call vote;
Councilmembers Torre, yes; Paulson, yes; Richards, yes; Semrau, yes;
Mayor Klanderud, yes. Motion carded.

RESOLUTION #48~ SERIES OF 2004 Aspen Highlands Village PUD
Finding of Substantial Compliance with Subdivision Approval
Councilwoman Richards moved to continue Resolution #48, Series of 2004,
to August 23; seconded by Councilman Semrau. All in favor, motion
carried.
Councilman Torre moved to go into executive session at 5:25 p.m. pursuant
to C.R.S. 24-6-402(4)(a), discussion of property acquisition; seconded by
Councilwoman Richards. All in favor, motion carded.
Councilman Semrau moved to come out of executive session at 5:45 p.m.;
seconded by Councilman Torre. All in favor, motion carded.
Councilman Semrau moved to adjourn at 5:45 p.m.; seconded by
Councilwoman Richards. All in favor, motion carried.
