City of Aspen, Colorado. and
~E~EAS, the'applicant has applied to the City of Aspen for a bu[ld[~ permit
for the purpose of constructi~ ~ereon a residential duplex building which is a pertained
use thereof; and
~EREAS, land owners have in the p~st recorded condominium pl~ts with the ~ ......
P[tkin County Clerk and Recorder without obta[n[~ the prior approval of the Aspen City
Council therefor, and ~n contravention of the Municipal Code of the City of Aspen; and
~EREAS, it is the desire of the C[~ of Aspen and thepurpose of this Stipulation
~ place of record notice that a condom[ni~ ~n~rest ca~ot be conveyed, w~th respect to
the real proper~ here[nabove described, without compliance with the subdivision regulations
contained in Chapter 20 of the Municipal Code of the City of Aspen,
NOW, T~REF~E, IT IS AGREED A~ STIPULATED BY T~ APPLICA~
that he will not convey any condominium in. rest in, or with respect to, the real property
hereinabove described ~n contravention of, or without full compliance with. Chapter 20
of the Municipal Code of lhe City of Aspen.
Applicant fu~her agrees that this Stipulation and agreement shall be a covert
runni~ with the land, and shall bind h~mself, his heirs, successors and assigns.
