HomeMy WebLinkAboutminutes.council.20041130Special Meeting Aspen City Council November 30, 2004 Mayor Klanderud called the meeting to order at 4:50 p.m. with Councilmembers Torre, Richards, Paulson and Semrau present. RESOLUTION #121, SERIES OF 2004 - Phase One Construction Contract Shaw for Burlingame Housing Ed Sadler, assistant city manager, told Council staff worked with Shaw on the scope of work, the schedule and the price. Sadler noted the price is $2.2 million, which is about 7% of the estimated project costs. Shaw has outlined how they arrived at $2.2 million. The proposed schedule is attached to the contract. Sadler said all the requirements of the city are included in the contract by reference. Sadler said the city did some very limited geotechnical work. Shaw has added a more thorough geotechnical investigation to their contract. Shaw has assumed this project will be tax exempt and they will apply for that. John Worcester, city attorney, told Council before the city executes the phase I contract; any issues with phase II contract will be discussed with the contractor. Councilman Semrau said he would like to see the time commitment of 14 months from building permit to CO immemorialized in the contract. Section 1.3.5 of this contract has a statement of the proposed schedule and Councilman Semrau requested that 14-month commitment be inserted. Sadler told Council staffhas drafted a calendar of everything that has to happen for this project. Sadler said if this project gets a late start, the completion time will be longer. Councilman Semrau said the 14-month commitment was based on a spring 2005 start. Once the building permit is issued, the developer controls the time line. Worcester suggested adding, "Receipt of final CO, within 14 months of building permit issuance, assuming building permit is issued no later than May 30, 2005". Worcester noted Council is under no obligation to enter into phase II of the contract. Councilman Semrau said the city can get out without cause. Councilman Semrau asked if the estimate for phase II is higher than expected, could the city get out of the contract. Worcester said yes. Councilman Semrau noted the contract says the Build American standards will be filled. Sadler said this is referenced in their submission. Councilman Semrau asked if there will be a Build America review of the final plans. Sadler said at several intervals during design, the applicants will submit to Build America for comments on where the project is in meeting the standards. Build America has agreed to issue the city a letter on these standards once the designs are complete. Councilman Semrau asked if this should be included in the contract. Worcester said it should be added as part of the scope of work. Councilwoman Richards asked if this contract addresses any third party delays. Worcester reiterated the city has an out for no reason with 7 days notice. Mayor Klanderud asked if the new trail connection is included in this contract. Sadler said this contract deals only with what is in place right now. That trail connection would be a change order and that alignment is not approved. Councilman Torre asked about the cost for the transit engineering. Sadler said this is for things like road layout and traffic circulation, which the applicants are required to do as part of their approvals. Special Meeting Aspen City Council November 30, 2004 Councilman Semrau moved to approve Resolution #121, Series of 2004, authorizing the city manager to sign a contract in substantially the form as presented; seconded by Councilwoman Richards. Councilwoman Richards asked if the applicants are handling public relations as part of this contract. Sadler said not at this point; however, it will move to them once construction is started. The calls are being handled by city staff and by Ben Gagnon, who has been hired to assist with public information. All in favor, with the exception of Councilman Paulson. Motion carried.
